Explanation
This legislation authorizes a modification and increase to the design contract with Barr Engineering, Incorporated for the North High Street - Flint Road to Delaware County Line project. This project will widen High Street by one lane in each direction, add sidewalks and curb ramps and includes some traffic signal work. The limits for this project are from Flint Road to the Delaware County line. The contract modification is necessary to update the curb ramp plans to current specifications so that this project can start construction in the spring of 2006. This modification is an addition to the original scope of services and is a continuation of the existing work being performed and would not be practical to contract with a different consultant. Current hourly rates, the overhead rate and the percentage of profit that were negotiated at the beginning of this project were used to determine the amount of this modification. Barr Engineering, Incorporated, contract compliance #31-1347309 (expires 11/18/2006) was selected in 1996 in accordance with City Code Chapter 329 for professional service contracts.
The original contract amount was for $209,840.00. This is the first modification. The cost of this modification is $50,000.00. The total cost of the contract with this modification is $259,840.00.
Fiscal Impact: The Transportation Division budgeted $100,000 in the 2004 Capital Improvements Budget for this contract modification. This ordinance authorizes and expenditure of $50,000.00. The additional funds will be available for any future contract modifications or related project costs.
Emergency action is requested to that the project design can be completed as soon as possible and allow construction to start in the spring of 2006.

WHEREAS, contract CT-17926 for the design of the North High Street - Flint Road to Delaware County Line project was authorized by Ordinance 3088-1996 passed December 16, 1996, executed January 13, 1997, and approved by the City Attorney on January 16, 1997; and
WHEREAS, it is necessary to modify this contract to expand the scope of services to cover the cost of plan revisions and updates; and
WHEREAS, funds for this contract modification are budgeted and available within the arterial Street Rehabilitation project in the 1995, 1999 Voted Streets and Highways Fund with the summer bond sale; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contract should be modified and increased immediately for the earliest possible completion of the design to allow construction to start in the spring of 2006, thereby preserving the public health, peace, property, safety and welfare; now therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Public Service Director be and hereby is authorized to modify and increase Contract No. CT-17926 with Barr Engineering, Incorporated, 1108 City Park Avenue, Suite 200, Columbus, OH 43206 to complete the design of and secure permits for the North High Street - Flint Road to the Delaware County Line project for the Transportation Division in accordance with the specifications on file in the office of the Public Service Director.
SECTION 2. That for the purpose of paying the cost of the contract modification the sum of $50,000.00, or so much thereof as may be necessary, be and hereby is authorized to be expended from Fund 704, the Voted 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6682, OCA Code 644385 and Project 530103.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
