NORTH CENTRAL AREA COMMISSION RECOMMENDATION: Approval.
CITY DEPARTMENTS' RECOMMENDATION: Approval. The applicant has received a recommendation of approval from Staff and the Development Commission for a concurrent rezoning (Ordinance #3053-2024; Z24-031) to the L-M, Limited Manufacturing District for limited manufacturing uses. The requested Council variance will allow for reduced parking and building setbacks, and the relocation of a tree island. Staff recognize new plantings and landscaping along Brentnell Avenue as a mitigating factor for support of the request to move the tree island to the end of the drive aisle.

WHEREAS, by application #CV24-092, the owner of the property 2025 LEONARD AVE. (43219), requests a Council variance to allow reduced development standards for a bus repair facility and parking lot in the L-M, Limited Manufacturing District; and
WHEREAS, Section 3312.21(A), Landscaping and screening, requires interior parking lot shade trees, while the applicant proposes the parking lot shade trees be moved to the end of the aisle, as shown on the site plan included with Ordinance #3053-2024 (Z24-031); and
WHEREAS, Section 3312.27, Parking setback line, requires a minimum 25 foot parking setback line along public streets, while the applicant proposes a reduced parking setback of 10 feet along Leonard Avenue and Brentnell Avenue; and
WHEREAS, 3363.24, Building lines in an M-manufacturing district, requires a building setback line of 40 feet along Leonard Avenue and 25 feet along Brentnell Avenue, while the applicant proposes a reduced building setback of 10 feet along the Leonard Avenue and Brentnell Avenue frontages for a fence with a height of 10 feet; and
WHEREAS, the North Central Area Commission recommends approval of said zoning change;
WHEREAS, City Departments recommend approval because of the presence of adequate landscaping; and
WHEREAS, this ordinance requires separate submission for all applicable permits and a Certificate of Occupancy for the proposed development; and
WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and
WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and
WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 2025 LEONARD AVE. (43219), in using said property as desired; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That a variance is hereby granted from the provisions of Sections 3312.21(A), Landscaping and screening; 3312.27, Parking setback line; and 3363.24, Building lines in an M-manufacturing district; of the Columbus City Codes; for the property located at 2025 LEONARD AVE. (43219), to allow a tree island to be relocated to the end of the parking lot aisle; reduced parking setback lines from 25 feet to 10 feet along Leonard Avenue and Brentnell Avenue; and a reduced building setback line from 40 feet to 10 feet along Leonard Avenue and from 25 feet to 10 feet along Brentnell Avenue for a fence with a height of 10 feet; said property being more particularly described as follows:
2025 LEONARD AVE. (43219), being 1.37± acres located at the southwest corner of Leonard Avenue and Brentnell Avenue, and being more particularly described as follows:
Situated in the City of Columbus, County of Franklin, State of Ohio, being all of Lots One Hundred Three (103) to One Hundred Fourteen (114), part of Lot One Hundred Fifteen (115), and part of the north south alley located north of the south lines of Lot One Hundred Three ( 103) and Lot One Hundred Sixteen (116) as recorded on the plat of H.H. Parson's Subdivision recorded in Plat Book 7, Page 238 in the Franklin County's Recorder's Office, being more particularly bounded and described as follows:
Beginning at a 3/4 inch diameter Iron Pipe Found (12 Inches Deep) at the north corner of Lot One Hundred Twelve (112) of said H.H. Parson's Subdivision, in the south Right-of-Way line of Leonard Avenue (60 feet Wide) and west Right-of-Way line of Brentnell Avenue (60 feet Wide), said Iron Pipe Found being the TRUE POINT OF BEGINNING;
Thence with the west line of Brentnell Avenue, S02°55'27"W 363.77 feet to a Mag Nail Found in the north line of a 16 foot wide alley at the south east corner of Lot One Hundred Three (103);
Thence with the north line of said alley, crossing through the above mentioned north south alley, N86°38'11"W 164.87 feet to a 1/2 inch diameter Iron Pipe Found (Bent, Broken) at the south east corner of Lot One Hundred Sixteen (116);
Thence with the west line of said north south alley, passing the south east corner of Lot One Hundred Fifteen (115) at 40.23 feet, N03"13'13"E 47.08 feet to an Iron Pin Found (CW Design Group LLC);
Thence with a line through said Lot One Hundred Fifteen ( 115) and being 4 feet east of and parallel to the east line of Lot One Hundred Sixteen (116), N31°32'56"W 166.91 feet to a 1 Inch diameter Iron Pipe Found in the south line of Leonard Avenue;
Thence with the south line of Leonard Avenue, N58°27'41"E 314.25 feet to the TRUE POINT OF BEGINNING;

The bearings described herein are based on the Ohio State Plane Coordinate System, South Zone, NAD83 (2011) Epoch 2010. The south line of Leonard Avenue, having a bearing of N58°27'41"E and monumented as described herein is designated the "basis of bearing" for this survey.
SECTION 2. That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for those uses allowed in the L-M, Limited Manufacturing District, specified by Ordinance #3053-2024 (Z24-031).
SECTION 3. That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed development.
SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
