Explanation
 
The purpose of this legislation is to authorize the Director of Public Utilities to modify an existing agreement with US Filter/Envirex for additional emergency repairs of Dystor framework on Digester#1 for the Jackson Pike Wastewater Treatment Plant with US Filter/Envirex.  On March 23, 2004, the Division of Sewerage and Drainage, Jackson Pike Wastewater Treatment Plant experienced a superstructure failure on the Dystor framework of Digester #1. The cover is part of the Biogas (methane) handling system at the wastewater treatment plant. The plant had to take immediate action to correct the structure and have it supported. If this structure did not receive immediate attention, there was a potential for the gas well to fall into the digester and the risk of an explosion. Some of the collapsed structure punctured the fabric. Since the incident the treatment capacity has of the digester has fallen 16%
 
The Jackson Pike Wastewater Treatment Plant immediately contacted the manufacturer of the Digester cover US Filter/Envirex Inc. The company immediately placed supports to reinforce the structure to diminish the risk of total collapse or explosion. However, the structure needs to be replaced and the risks of collapse and explosion are still present. US Filter/ Envirex will fabricate and then install a new cover which will take approximately 10 weeks to accomplish.
 
On May 30, 2005 a wind storm collapsed the structure into the digester which ripped the membranes.  Though the digester is not in service, this situation has caused a reduction in capacity and could lead to by -pass to the Southerly Wastewater Treatment Plant which would create more stress on their treatment system.  The additional work includes the temporary support of the structure, replacement of the inner and outer membrane, testing, re-inflation and restart of Digester #1
 
The lead time to obtain the necessary supplies and parts to repair the digester is 8-10weeks and there was not sufficient time to receive formal bids to secure and ultimately repair the structure. This ordinance is being submitted as waiver legislation in accordance with Columbus City Code Section 329.17

FISCAL IMPACT: $221,900.00 in additional funding is needed for the additional work.
 
Emergency legislation is being requested so that work can commence and the repairs can be expedited so that Digester #1 can be restarted and capacity is not further reduced at the Jackson Pike Wastewater Treatment Plant.

WHEREAS, the capacity of the Jackson Pike Wastewater Treatment Plant has been reduced significantly and with the Digester out of service could ultimately create a by-pass situation to the Southerly Wastewater Treatment Plant causing stress on the plants treatment process, and
 
WHEREAS, there was not sufficient time to receive formal bids so this ordinance is being submitted as a waiver in accordance with Columbus City Code Section 329.17, and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Sewerage and Drainage in that it is immediately necessary to modify an existing contract so that work can commence and the repairs can be expedited so that Digester #1 can be restarted and capacity is not further reduced at the Jackson Pike Wastewater Treatment Plant with US Filter/Envirex for the immediate preservation of the public health, peace, property and safety; now, therefore
 
BE IT ORDINANCE BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1. That the Director of Public Utilities be and is hereby authorized to modify an existing contract with US Filter/Envirex for additional repairs of the Digester #1 membranes for the Division of Sewerage and Drainage, Jackson Pike Wastewater Treatment Plant.
 
Section 2. That in accordance with Section 329.17 of the Columbus City Codes, the Columbus City Council finds it in the best interest of the City of Columbus to waive formal competitive bidding requirements and that 329.07 of the Columbus City Code is hereby waived.
 
Section 3. That the expenditure of $221,900.00 or so much thereof as may be needed, be and the same hereby is authorized from the Sewerage System Operating Fund, Fund No. 650, OCA 6048191, Object Level 1: 06, Object Level 03: 6624
 
Section 4. That for the reasons stated in the preamble hereto, where is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure, which shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
