Explanation
 
Background:  This legislation authorizes the City to enter into a contract in an amount up to $777,573.55 for the Crack Seal 2007 project and to pay construction inspection costs up to $38,878.68.  This improvement consists of crack sealing arterial and residential streets. The estimated Notice to Proceed date is July, 2007. This project has been given 90 days to complete the construction of the project.  The project was let by the Transportation Division and was advertised in the City Bulletin, Dodge Reports, and by the Builders Exchange.  Three (3) bidders/suppliers requested bids (3 majority, 0 minority) and two (2) bids were received (2 majority, 0 minority) and tabulated on May 24, 2007 as follows:

Strawser, Inc.
$797,172.29
                               
Award is to be made to American Pavements, Inc. c.c. #31-1409601 (expiring January 13, 2008), as the lowest responsive, responsible  and best bidder.
 
Emergency action is requested to allow the project to be completed in the 2007 construction season.
 
Fiscal Impact:  Funding for this project in the amount of $816,452.23 is budgeted with the Transportation Division as part of the 2007 Capital Improvement Program and is available within the 1995, 1999, 2004 Voted Streets and Highways Fund for this work.

To authorize the Public Service Director to enter into a contract for the Transportation Division with American Pavements, Inc. for construction of the Crack Seal 2007 project; to authorize the expenditure of $816,452.23 from the 1995, 1999, 2004 Voted Streets and Highway Fund; and to declare an emergency. ($816,452.23).
 
Body
 
WHEREAS, bids were received on May 24, 2007, and tabulated on May 30, 2007, for the Crack Seal 2007 project; and
 
WHEREAS, a satisfactory bid has been received; and
 
WHEREAS, it is necessary to provide for construction inspection costs; and
 
WHEREAS, an emergency exists in the usual daily operation of the Transportation Division in that the contract should be awarded immediately so that the work may be completed in the 2007 contruction season, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Public Service Director be and is hereby authorized to enter into a contract with American Pavements, Inc., 7475 Montgomery Drive, Plain City, Ohio 43064, for the construction of  the Crack Seal 2007 in the amount of $777,573.55, for the Transportation Division in accordance with the specifications and plans on file in the office of the Director of Public Service, which are hereby approved; and to obtain and pay for the necessary inspection costs associated with the project up to a maximum of $38,878.68.
 
SECTION 2.  That for the purpose of paying the cost of the contract and inspection, the sum of $816,452.23 or so much thereof as may be needed, is hereby authorized to be expended for the 1995, 1999, 2004 Voted Streets and Highways Fund, No. 704 for the Transportation Division, Dept./Div. 59-09, OCA Code 644385, Object level 6631 and project 530282.
 
SECTION 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
