Explanation

Background:

This legislation authorizes an amendment to Ordinance No. 3395-2024, passed by City Council December 16, 2024, to allow a correction that authorizes the purchase of food and non-alcoholic beverages for Hilltop RISE Economic Community Development Corporation’s community agency support grant. This language was originally intended to be included in the legislation. This needs to be corrected and to be reflective of the effective date of this ordinance.

Ordinance No. 3395-2024 authorized the Director of the Department of Neighborhoods, on behalf of the City, to enter into contract with Hilltop RISE Economic Community Development Corporation to support the non-profit’s administrative and personnel costs.

Hilltop RISE Economic Community Development Corporation is a non-profit Economic Community Development Corporation working to enhance the streetscapes along historic business corridors, preserve affordable commercial real estate, and attract businesses and customers to revitalize the neighborhood for the Greater Hilltop community.

Fiscal Impact: No additional funding is required to modify this contract.

Emergency Justification: Emergency action is requested to allow for the immediate execution of this agreement in order to prevent Hilltop RISE Economic Community Development Corporation from experiencing financial hardship.

Body

WHEREAS, Ordinance No. 3395-2024 passed by City Council on December 16, 2024, authorized the Director of the Department of Neighborhoods to enter into a grant agreement with Hilltop RISE Economic Community Development Corporation to provide community agency support; and

WHEREAS, it was recently discovered that the legislation did not clearly state that food and non-alcoholic beverages would be an allowable expense by Hilltop RISE Economic Community Development Corporation; and

WHEREAS, the Director of the Department of Neighborhoods requests that Ordinance 3395-2024 be amended in order to correct the inadvertent omission; and

WHEREAS, an emergency exists in the usual daily operation of the Department of Neighborhoods in that it is immediately necessary to amend Ordinance 3395-2024, passed by Columbus City Council on December 16, 2024, in order to prevent Hilltop RISE from experiencing financial hardship; and NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

SECTION 1. That title of Ordinance No. 3395-2024 is hereby amended as follows with additions in underline and deletions in strikethrough:

To authorize the Director of the Department of Neighborhoods to enter into a grant agreement with Hilltop Rise Economic Community Development Corporation to authorize the expenditure of $146,000.00 from the Department of Neighborhoods General Fund 1000; to advance funding per a predetermined schedule; to authorize the payment for reasonable food and non-alcoholic beverages; and to declare an emergency. ($146,000.00)

 

SECTION 2. That the existing title of Ordinance 3395-2024 is hereby repealed.

SECTION 3. The new Section 1 of Ordinance 3395-2024 is hereby adopted and that the existing Section 1 of Ordinance 3395-2024 is hereby amended as follows:

SECTION 1. That the Director of the Department of Neighborhoods is hereby authorized to enter into a grant agreement with Hilltop Rise Economic Community Development Corporation and is authorized to advance funds per a schedule and authorized to pay for reasonable food and non-alcoholic beverages to be included in the agreement.  That Columbus City Council acknowledges and defines as operating costs inherent to the mission of this non-profit corporation the purchase of food and non-alcoholic beverages to support the strengthening of key gateways into the neighborhood, new business development, and the improvement of business services for entrepreneurs.  No more than 5% of the expenditure authorized by this ordinance may be spent toward payment of food and non-alcoholic beverage expenses for the aforementioned purpose.  Expenses incurred prior to the creation of a purchase order may be reimbursed.  However, in no case may food and non-alcoholic beverage expenses incurred prior to the effective date of this ordinance be reimbursed.  City Council declares that the expenditure on food and non-alcoholic beverage expenses authorized by this ordinance to be for a proper public purpose.

 

 

SECTION 4. The existing Section 1 of Ordinance No. 3395-2024 is hereby repealed.

SECTION 5. That all other sections of Ordinance No. 3395-2024 not expressly amended or repealed by this Ordinance shall remain in full force and effect.

SECTION 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
