Explanation
BACKGROUND: This ordinance authorizes the Public Utilities Director to modify and increase a professional engineering services contract with Evans, Mechwart, Hambleton & Tilton, Inc., for the Linden Avenue Area Wide Storm System Improvements Project, which is a part of the Group 8A Area Wide Stormwater System Improvements, and to amend the 2005 Capital Improvements Budget. This modification is for additional designing services for the Division of Water and Department of Development. This is the second modification to the original contract.
Amount of additional funds to be expended: $49,111.00
Original Contract Amount: $ 551,658.68 (Group 8A total) {$255,246.68 (Linden's amount)}

Reasons additional goods/services could not be foreseen:
During the final plan review, the Division of Water identified several water lines in the project area which were determined are at the end of their useful life. Subsequently, they requested the Division of Sewerage and Drainage include replacement of said water lines into the plans, necessitating revisions to the plans.
Additionally, at the request of the Department of Development, Greenview Estates Detention Basin plans were separated from the rest of the project and finalized on an accelerated schedule, to be included within the Rough Grading and Utilities Package for Greenview Estates Subdivision.
Reason other procurement processes are not used:
The work under this contract modification is a plan update/revision work to be done as part of the final plan review process.
How cost of modification was determined:
Price quotes for the additional design services under this modification were requested by the Division of Sewerage and Drainage, prepared by the design engineer, and were subsequently reviewed by Division personnel and deemed to be appropriate.

Emergency designation is requested for this ordinance so that improvements may be incorporated into the design phase of this project without delaying the proposed project schedule.
FISCAL IMPACT: The Division of Sewerage and Drainage is requesting an amendment to the 2005 Capital Improvements Budget for purposes of establishing sufficient budget authority for this expenditure. There is sufficient cash for the expenditures associated with this project.

To authorize the Director of Public Utilities to modify and increase an existing contract with Evans, Mechwart, Hambleton & Tilton, Inc., for additional design services associated with the Linden Avenue Area Wide Storm System Improvements Project, which is part of the Group 8A Area Wide Stormwater System Improvements, for the Division of Sewerage and Drainage, to authorize the expenditure of $49,111.00 within the Storm Sewer Bonds Fund, to authorize an amendment to the 2005 Capital Improvements Budget, and to declare an emergency. WHEREAS, Contract No. XC820031 was authorized by Ordinance No. 2968-98, passed November 16, 1998; executed December 11, 1998; and approved by the City Attorney on January 28, 1999; and
WHEREAS, Modification No. 1 was authorized by Ordinance No. 290-03, passed February 24, 2003; was executed February 26, 2003; and was approved by the City Attorney on March 6, 2003; and
WHEREAS, additional design services are needed to revise construction plans to add water line replacement design and to separate construction plans for Greenview Estates Detention Basin from the rest of the project; and
WHEREAS, it is necessary to modify Contract No. XC820031 to authorize the funds required to allow payment to Evans, Mechwart, Hambleton & Tilton, Inc. for additional engineering design services associated with the Linden Avenue Area Wide Storm System Improvements Project; and
WHEREAS, it is necessary to authorize an amendment to the 2005 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for the aforementioned project expenditure; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Utilities, Division of Sewerage and Drainage, in that it is immediately necessary to modify and increase the existing contract with Evans, Mechwart, Hambleton & Tilton, Inc., for the Linden Avenue Area Wide Storm System Improvements Project, which is a part of the Group 8A Area Wide Stormwater System Improvements, in an emergency manner so that improvements may be incorporated into the design phase of this project without delaying the proposed project schedule, for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Public Utilities Director is hereby authorized and directed to modify and increase an existing professional engineering services contract, with Evans, Mechwart, Hambleton & Tilton, Inc., for the Linden Avenue Area Wide Storm System Improvements Project, which is a part of the Group 8A Area Wide Stormwater System Improvements, in the amount of $49,111.00.
SECTION 2. That this contract modification is in compliance with Section 329.13 of Columbus City Codes, 1959.
SECTION 3. That for the purpose of paying the cost of the contract modification, the sum of $49,111.00 or so much thereof as may be necessary be and hereby is authorized to be expended from Fund 685, the Storm Sewer Bonds Fund, Department No. 60-15, Sewerage and Drainage Division, Object Level One Code 06, Object Level Three Code 6682, OCA Code 685704 and Project 610704.
SECTION 4. That the 2005 Capital Improvements Budget Ordinance No. 1070-2005 is hereby amended as follows, in order to establish sufficient funding authority:

SECTION 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
