Title: To authorize and direct the Finance Director to modify and extend the citywide contracts for the option to purchase Rental of Construction Equipment w/Operator., with Johnny Jenkins/Travco Construction Co (FL000856) and Right Way Excavating Co (FL000859) and to declare an emergency.
Explanation
 
BACKGROUND:  To modify and extend the existing city-wide contracts for the option to purchase Rental of Construction Equipment w/Operator for various city agencies to and including April 30, 2005.  Formal bids were opened by the Purchasing Office on July 19, 2001. The Purchasing Office advertised and solicited competitive bids in accordance with Section 329.06. (Proposal No. SA000068 GRW). FL000856, with Johnny Jenkins/Travco Construction Co (CC# 311771566) and FL000859 with Right Way Excavating Co (CC# 311633753). were established in accordance with bids received.
 
These companies are not debarred according to the Federal Excluded Parties Listing or the State Auditor's Findings For Recovery Database.
 
1.  Amount of additional funds:  The estimated annual expenditure for the contract is $2,150,000.00. Johnny Jenkins/Travco Construction co ($2,025,000.00) and Right Way Excavating Co ($125,000.00). Agencies must obtain approval to expend from their own budgeted funds for their estimated expenditures.
2. Reason additional needs were not foreseen: Unanticipated delays finalizing new bid specifications necessitate extending the existing agreements.
3. Reason other procurement processes not used: The exact same products or services are required as originally bid. The city is currently working to revise and update the bid specifications. A new bid will be solicited when the new specifications are complete.
4. How cost was determined: The cost, terms and conditions are in accordance with the original agreement
 
FISCAL IMPACT: No funding is required to extend the option contracts. City agencies fund their expenditures from their budgets, and request expenditure approval where the estimated expenditure during a calendar year on a single contract will exceed $100,000.
 
To maintain an uninterrupted supply of service to the City Agency using these Universal Term Contracts, this ordinance is be submitted as an emergency.

To authorize and direct the Finance Director to modify and extend the citywide contracts for the option to purchase Rental of Construction Equipment w/Operator., with Johnny Jenkins/Travco Construction Co (FL000856) and Right Way Excavating Co (FL000859) and to declare an emergency.
 
 
Body
 
WHEREAS, the Purchasing Office advertised and solicited formal bids, and selected the lowest bids; and
 
WHEREAS, vendors have agreed to extend FL000856 with Johnny Jenkins/Travco Construction Co. and FL000859 with Right Way Excavating Co at current prices and conditions to and including April 30, 2005, and it is in the best interest of the City to exercise this option; and
 
WHEREAS, the existing contract expires August 31, 2004 and insufficient time exists to solicit bids, evaluate and award prior to the current contract expiration date.
 
WHEREAS, an emergency exists in the usual daily operation of the Sewerage & Drainage Division, Water Division and the  Recreation & Parks Department in that it is immediately necessary to extend FL000856 and FL000859 for the option to purchase Rental of Construction Equipment w/Operator in order to maintain an uninterrupted supply of service to these agencies thereby preserving the public health, peace, property, safety, and welfare, now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1. That the Finance Director be and is hereby authorized and directed to modify and extend FL000856 with Johnny Jenkins/Travco Construction Co and FL000859 with Right Way Excavating Co. to and including April 30, 2005
 
SECTION 2. That this modification is in accordance with Section 329.16 of the Columbus City Codes.
 
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
