Explanation

1. BACKGROUND

Ordinance No. 1560-2026, passed by Columbus City Council on June 8, 2026 authorized the Director of Finance and Management to enter into contract with BEC Enterprises LLC for the purchase of a trail mounted aggregate heater, to authorize the expenditure of up to $98,735.54 from the Streets & Highways Bond Fund to purchase the equipment, and to declare an emergency. 

This legislation authorizes an amendment to that ordinance for the sole purpose of including bid waiver language in order to accept and award BEC Enterprises LLC because the quote submitted with the bid was not valid for 180 days as required by bidding terms and conditions.

Title

To amend Ordinance 1560-2026 for the sole purpose of including the authorization of waiving the competitive bidding provisions of Columbus City Code; and to declare an emergency. ($0.00)

Body

WHEREAS, Ordinance 1560-2026 authorized the Director of Finance and Management to enter into contract with BEC Enterprises LLC for the purchase of a trail mounted aggregate heater, to authorize the expenditure of up to $98,735.54 from the Streets & Highways Bond Fund to purchase the equipment, and declare an emergency; and

WHEREAS, after passage of Ordinance 1560-2026 it was determined that bid waiver language should have been included due to the quote not being valid for 180 days as required by the bidding terms and conditions; and 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that additional funds should be authorized immediately so that the equipment can be purchased and used during the current street maintenance season, thereby preserving the public health, peace, property, safety and welfare; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

SECTION 1: That the background of Ordinance Number 1560-2026, passed by Columbus City Council on June 8, 2026, is hereby amended is hereby amended to be revised as follows to include the following:

                     REQUEST FOR WAIVER OF FORMAL COMPETITIVE BIDDING REQUIREMENTS

A request for waiver of the formal competitive bidding requirements of Columbus City Code Chapter 329 is requested for this purchase so that the Division of Infrastructure Management can purchase and use the equipment during the current season to maintain the infrastructure and roadways throughout the City.

SECTION 2. That the recitals of Ordinance Number 1560-2026, passed June 8, 2026, are hereby amended to be revised as follows to include the following recital:

WHEREAS, it is in the City's best interests to waive the competitive bidding provisions of City Code Chapter 329 to procure this equipment so the division is able to purchase and use the equipment during the current season to maintain the infrastructure and roadways throughout the City; and

SECTION 3. That Sections 2 to 7 of Ordinance Number 1560-2026, passed June 8, 2026, are hereby amended to be revised as follows:

                     SECTION 2. That City Council finds it is in the best interest of the City of Columbus to waive the formal competitive bidding requirements of City Code Chapter 329 and does hereby waive the same.

SECTION 2 3.  That the Director of Finance and Management be and is hereby authorized to associate all General Budget Reservations resulting from this ordinance with the appropriate agreement with BEC Enterprises LLC for the purchase of (1) Trail Mounted Aggregate Heater.

SECTION 3 4.  That the expenditure of $98,735.54, or so much thereof as may be needed, is hereby authorized in Fund 7704 (Street & Highways Bond Fund), Dept-Div 5911 (Infrastructure Management), in Object Class 06 (Capital Outlay) per the accounting codes in the attachment to this ordinance.

SECTION 4 5.  That funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

SECTION 5 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

SECTION 6 7.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

SECTION 7 8.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.

SECTION 4: That existing Sections 2 to 7 of Ordinance Number 1560-2026, passed June 8, 2026, are hereby repealed.

SECTION 5: That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
