Explanation
 
1.      BACKGROUND:
 
A.      Need.  This legislation authorizes the Director of Public Utilities to enter into a construction contract with The Great Lakes Construction Co., for the Jackson Pike Wastewater Treatment Plant New Headworks project for the Division of Sewerage and Drainage.
 
The proposed contract with The Great Lakes Construction Co. is for Contract J208, Berliner Site Decommissioning and New Grit Pad at the Jackson Pike Wastewater Treatment Plant (JPWWTP).  The construction work consists of three sites:
 
1.      Berliner Site Decommissioning
Decommissioning of existing DOSD facilities, modification of the existing grit tanks to route 108-inch OSIS through the tanks, demolition of the concrete grit pad and various site work.
2.      Harmon Avenue/Emig Road
Construction of a new grit pad, storage building, a new gate and various miscellaneous site work.
3.      Jackson Pike WWTP
Replacement of two chain link fence gates and operators, replacement of operator for a third gate, security system and associated electrical work, minor concrete work and minor miscellaneous site work.
 
The contract was advertised in the City Bulletin, and bids were received on January 27, 2009, as follows:
1.      The Great Lakes Construction Co.  | MAJ | $4,982,375.00
2.      Kenmore Construction Co., Inc. | MAJ | $5,898,235.00
3.      Kokosing Construction Co., Inc. | MAJ | $5,932,735.00
 
The Engineer's construction cost estimate was $8,000,000.00.
 
      Award is recommended to the lowest Responsive and Responsible and Best Bidder.

2.      FISCAL IMPACT:
 
This legislation appropriates a total of $4,947,875.00 from the WPCLF Loan that will be utilized for the Jackson Pike Wastewater Treatment Plant New Headworks project, authorizes the transfer within and the expenditure $34,500.00 in non-eligible fees from the Build America Bond (B.A.B.s) Fund., and to amend the 2010 Capital Improvements Budget is amended for this expenditure upon passage of this ordinance.

Body
 
WHEREAS, three competitive bids for construction of the Jackson Pike Wastewater Treatment Plant New Headworks project, Contract J208, were received and opened on March 10, 2009 in the offices of the Director of Public Utilities; and
 
WHEREAS, the Division of Sewerage and Drainage engineering personnel have determined it necessary to enter into a construction contract with The Great Lakes Construction Co, in order to provide for construction of Jackson Pike Wastewater Treatment Plant New Headworks project, Contract J208; and
 
WHEREAS, the Ohio Water Development Authority (OWDA) approved a loan to the City of Columbus on April 29, 2010, in the amount of $5,075,306.00 identified as OWDA Account Number 5635  to provide financing for the above listed project with eligible costs including the construction contract and contingency; and capitalized interest; and
 
WHEREAS, it is necessary to authorize the transfer of $34,500.00 from the Sanitary B.A.B.s (Build America Bonds) Fund for purposes of providing sufficient funding for the aforementioned project expenditure; and
 
WHEREAS, it is necessary to amend the 2010 Capital Improvements Budget to provide sufficient authority for increasing a capital project account; and
 
WHEREAS, it is necessary to appropriate the proceeds from the aforementioned loan, authorize the expenditure of funds from the Sanitary B.A.B.s (Build America Bonds) Fund required to award the subject contract, and provide the requisite budget authority for said award; and
 
WHEREAS, the Division of Sewerage and Drainage, Department of Public Utilities is requesting that this Council authorize the Director of Public Utilities to enter into a construction contract with The Great Lakes Construction Co for the Jackson Pike Wastewater Treatment Plant New Headworks project for the preservation of the public health, welfare, peace, property, and safety; Now, Therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of Public Utilities be, and hereby is, authorized to enter into a contract with The Great Lakes Construction Co, 2608 Great Lakes Way, Hinckley, Ohio 44233-9590, for construction of the Jackson Pike Wastewater Treatment Plant New Headworks project t in accordance with the terms and conditions as shown on the contract on file in the office of the Division of Sewerage and Drainage.
 
Section 2. That the proceeds from the Ohio Water Development Authority Loan No. 5635, for the Jackson Pike Wastewater Treatment Plant New Headworks project; and funds from the unappropriated monies in Fund No. 666, the amount of $4,947,875.00 for the cost of the construction contract, is hereby appropriated to the Division of Sewerage and Drainage as follows:

Section 3.  That the City Auditor is hereby authorized to transfer $4,947,875.00 to the Water Pollution Control  Loan Fund No. 666, into the appropriate project accounts as specified in the below section, at such time as deemed necessary by him, and to expend said funds, or so much thereof as may be necessary.
 
Section 4.  That the City Auditor is hereby authorized to transfer $34,500.00 within the Department of Public Utilities Division of Sewerage and Drainage, Dept/Div. No. 60-05, Sewerage and Drainage Sanitary B.A.B.s (Build America Bonds) Fund, Fund No. 668, Object Level Three 6676, as follows:

Section 5.  That for the purpose of paying the cost of the construction contract, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows under the Water Pollution Control Loan:

Section 7.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
 
Section 8. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
Section 9.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
Section 10.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
