Explanation

 

1. Background

The City of Columbus, Department of Public Service, received a request from EMH&T Engineers, Surveyors, Planners, Scientists on behalf of the owner, OhioHealth Corporation, asking that the city allow encroachments into the public right-of-way. These encroachments consist of a wall shoring and drainage for the wall located along the north side of West North Broadway. These elements will extend into the public right-of-way as described below and shown on the attached exhibits.

 

The following legislation authorizes the Director of the Department of Public Service to execute those documents necessary for the city to grant these encroachments and legally allow these elements to extend into the public rights-of-way. Allowing these elements will permit a parking garage to be built as part of the design. A $500.00 value for the encroachment easements were established.

2. Fiscal Impact

The City will receive a total of $500.00, to be deposited in Fund 7748, Project P537650, for granting the requested encroachment easements.

Body

 

WHEREAS, the City of Columbus, Department of Public Service, received a request from EMH&T Engineers, Surveyors, Planners, Scientists on behalf of the owner, OhioHealth Corporation, asking that the city allow encroachments into the public right-of-way; and

 

WHEREAS, these encroachments consist of a wall shoring and drainage for the wall located along the north side of West North Broadway. These elements will extend into the public right-of-way as described below and shown on the attached exhibits; and

 

WHEREAS, the following legislation authorizes the Director of the Department of Public Service to execute those documents necessary for the city to grant these encroachments and legally allow these elements to extend into the public rights-of-way. Allowing these elements will permit a parking garage to be built as part of the design; and

 

WHEREAS, a value of $500.00 was established for the encroachment easements; NOW, THEREFORE;

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  Authorizes the Director of the Department of Public Service to execute those documents necessary for the city to grant these encroachments and legally allow these elements to extend into the public rights-of-way; to-wit:

BETWEEN 753.83’ TO 757’ ELEVATION (NAVD88)

Situated in the State of Ohio, County of Franklin, City of Columbus, lying Quarter Township 2, Township 1, Range 18, United States Military District, and being on, over and across the right-of-way of West North Broadway, and that 9.43 acre tract conveyed to City of Columbus, Ohio by deed of record in Deed Book 2951, Page 228 extending between an elevation of 753.83 feet to 757 feet (NAVD88) (all references are to the records of the Recorder’s Office, Franklin County, Ohio) and being more particularly described as follows: Beginning, for reference, at the common corner of said 9.43 acre tract, that 42.647 acre tract conveyed to OhioHealth Corporation by deed of record in Instrument Number 202505200052410, in the easterly line of that tract conveyed to CSX Transportation, Inc. by deeds of record in Deed Book 924, Page 338, Official Record 13276A16, Official Record 13283G13, Complete Record 8, Page 411, being in the northerly right-of-way line of West North Broadway; Thence South 85° 59' 11" East, with said northerly right-of-way line and the line common to said 42.647 and 9.43 acre tracts, a distance of 229.45 feet to a point; Thence South 82° 33' 30" East, continuing with said northerly right-of-way line and said common line, a distance of 17.51 feet to the TRUE POINT OF BEGINNING; Thence South 82° 33' 30" East, with said northerly right-of-way line and said common line, a distance of 2.77 feet to a point; Thence across said West North Broadway and said 9.43 acre tract, the following courses and distances: South 36° 22' 37" East, a distance of 36.10 feet to a point; South 86° 22' 21" East, a distance of 397.47 feet to a point; South 03° 37' 39" West, a distance of 2.00 feet to a point; North 86° 22' 21" West, a distance of 398.41 feet to a point; North 36° 22' 37" West, a distance of 38.95 feet to the TRUE POINT OF BEGINNING, containing 0.020 acre, more or less. The Vertical Datum is based on the elevations established by the Franklin County Engineering Department, at monument RINGLE, being 745.621 feet in elevation, at monument COC4-83, being 734.080 feet in elevation, at monument FCELANE, being 740.808 feet in elevation, at monument W188RESET, being 739.781 feet in elevation, and at monument NW-1 being 739.456 feet in elevation. The said elevations were transferred from said Franklin County Engineering Department monuments using static GPS procedures and differential leveling, to the site. Situated in the State of Ohio, County of Franklin, City of Columbus, lying Quarter Township 2, Township 1, Range 18, United States Military District, and being on, over and across the right-of-way of West North Broadway, and that 9.43 acre tract conveyed to City of Columbus, Ohio by deed of record in Deed Book 2951, Page 228 extending between elevation of 731 feet to 769.5 feet (all references are to the records of the Recorder’s Office, Franklin County, Ohio) and being more particularly described as follows: Beginning, for reference, at the common corner of said 9.43 acre tract, that 42.647 acre tract conveyed to OhioHealth Corporation by deed of record in Instrument Number 202505200052410, in the easterly line of that tract conveyed to CSX Transportation, Inc. by deeds of record in Deed Book 924, Page 338, Official Record 13276A16, Official Record 13283G13, Complete Record 8, Page 411, being in the northerly right-of-way line of West North Broadway; Thence South 85° 59' 11" East, with said northerly right-of-way line and the line common to said 42.647 and 9.43 acre tracts, a distance of 229.45 feet to a point; Thence South 82° 33' 30" East, continuing with said northerly right-of-way line and said common line, a distance of 20.29 feet to the TRUE POINT OF BEGINNING;

SECTION 2.  That the City Attorney is required to approve all instrument(s) associated with this ordinance prior to the director of the Department of Public Service executing and acknowledging any of those instrument(s). 

 

SECTION 3. That the City will receive a total of $500.00 to be deposited in Fund 7748, Project P537650, for granting the requested easement.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
