Explanation
1. BACKGROUND:
This legislation authorizes modifying the professional engineering services contract with URS Corporation in connection with the Big Walnut Augmentation/Rickenbacker Interceptor Sewer Project (BWARI Part 1); the Big Walnut Outfall Augmentation Sewer Project (BWARI Part 2); and the Big Walnut Outfall Augmentation Sewer Air Quailty Control Facility Project (AQCF).
This professional services contract was originally procured with a scope that included a multi-year renewable contract option for an entire scope of services. This provision allows the City to appropriate funds annually or on an as-needed basis depending upon the project's progress. This modification will fund services through March, 2008, and includes the engineering services during construction; materials testing; construction administration and inspection services for Part 1; Part 2 and the AQCF portions of the BWARI Project.
This project will construct in two parts. Part 1 will install a 168-inch diameter sanitary interceptor sewer from the Southerly Wastewater Treatment Plant to the Alum Creek Drive/State Route 317 intersection. Part 2 will construct a 144-inch diameter sanitary interceptor sewer from Alum Creek Drive/State Route 317 intersection north along Alum Creek Drive to the existing 108-inch Outfall Sewer and an Air Quality Control Facility (AQCF). The included Shook Road connection will allow the removal of the Spiegel Road pump station and a 42-inch trunk sewer that will be constructed to service the Rickenbacker Port Authority and will allow for the removal of the present pump station.
2. PROFESSIONAL ENGINEERING SERVICES MODIFICATION AWARD:
This contract is a multi-year contract that allows the City to appropriate funds on an as-need basis to cover the costs of services for a 12-18 month period, and is necessary to fulfill the schedule and funding commitments for this project. This work is a planned, continuation of the services as originally included within the existing contract's scope of service. The contract total, including this modification is $27,187,780.00. It is also projected that another modification will be required in fiscal year 2008 based upon current project schedules. This project is part of the requirements delineated in the Consent Order Agreements between the City and the State of Ohio. These services are of a highly specialized and technical nature, and it is not practical or economical to have these services performed by city personnel. The costs have been deemed acceptable with the planned services for the remaining development of this project. These proposed costs were reviewed by division engineering personnel and have been deemed to be reasonable and appropriate.

WHEREAS, Contract No. CT18471 was authorized by Ordinance No. 1229-97, in the amount of $2,727,655.00, as passed by Columbus City Council on May 19, 1997, was executed July 18, 1997, and was approved by the City Attorney on August 22, 1997, for purposes of preparing construction plans, bid documents, the required geotechnical investigations; and to provide resident project representation services in connection with the Big Walnut Augmentation/Rickenbacker Interceptor Sewer Project, for the division of Sewerage and Drainage; and
WHEREAS, Modification No. 1, identified as City Auditor's Contract No. EL900308, in the amount of $4,291,842.00, was authorized by Ordinance No. 877-99, as passed April 12, 1999; and
WHEREAS, Modification No. 2, identified as City Auditor's Contract No. EL002367, in the amount of $2,700,000.00, was authorized by Ordinance No. 0615-02, as passed April 15, 2002; and
WHEREAS, Modification No. 3, identified as City Auditor's Contract No. EL003745, in the amount of $2,887,224.00, was authorized by Ordinance No. 1833-2003, as passed September 22, 2003; and
WHEREAS, Modification No. 4, identified as City Auditor's Contract No. EL005065, in the amount of $4,198,764.00, was authorized by Ordinance No. 1771-2004, as passed November 1, 2004; and
WHEREAS, Modification No. 5, identified as City Auditor's Contract No. EL006040, in the amount of $5,202,892.00, was authorized by Ordinance No. 0380-2006, as passed April 24, 2006; and
WHEREAS, the Division of Sewerage and Drainage has determined it is in the best interest of the Division to modify the subject contract in order to provide sufficient funds to continue with the professional engineering services during the remainder of Fiscal Year 2007 and part of 2008, which are necessary for the successful design and construction of Big Walnut Augmentation/Rickenbacker Interceptor Sewer Project; and
WHEREAS, it is necessary to authorize the Director of Public Utilities to modify the aforementioned professional engineering services contract, Modification No. 6, in the amount of $5,179,403.00, for the continuation of services associated with the Big Walnut Augmentation/Rickenbacker Interceptor Sewer Project; to appropriate and expend funds from the Sewerage System Reserve Fund to the Ohio Water Pollution Control Loan Fund; at the earliest practicable date; and
WHEREAS, it is necessary to authorize an amendment to the 2006 Capital Improvements Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditure; now therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities be, and hereby is, authorized to modify the professional engineering services contract, identified as City Auditor's Contract No. XC818471, with URS Corporation, Inc., 277 West Nationwide Boulevard, Columbus, Ohio 44125-2566, for professional engineering services associated with the Big Walnut/Rickenbacker Sanitary Interceptor Project, in accordance with the terms and conditions as shown in Modification No. 6 on file in the office of the Division of Sewerage and Drainage's, Sewer System Engineering Section.
Section 2. That the proceeds from the Ohio Water Development Authority Loan No. 4018, for the Big Walnut Augmentation/Rickenbacker Sanitary Interceptor Project; and funds from the unappropriated monies in Fund 666, the amount of $2,184,168.00 for the cost of construction administration and inspection services, is hereby appropriated to the Division of Sewerage and Drainage, Division 60-05, Fund No. 666:

Section 4. That for the purpose of paying the cost of the professional engineering services contract modification the expenditure of $2,184,168.00 or as much thereof as may be needed, is hereby authorized from the Ohio Water Pollution Control Loan Fund No. 666| Division 60-05| Project No. 650491| OCA Code No. 666491| Object Level Three No. 6676.
Section 5. That for the purpose of paying the cost of the professional engineering services contract
modification the expenditure of $2,995,235.00, or as much thereof as may be needed, is hereby authorized

Section 6. That the 2006 Capital Improvements Budget Ordinance No. 1108-2006 is hereby amended as follows, to provide sufficient budget authority for the execution of the cost agreement increase stated previously herein:

Section 7. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
Section 8. That this ordinance shall take effect and be in force from and after the earliest date allowed by law.
