APPLICANT:  City of Columbus and Columbus Municipal Airport Authority; 109 North Front Street; Columbus, OH 43215.
 
PROPOSED USE:  Manufacturing, commercial and/or office development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (4-0-1) on March 13, 2008.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The requested M, Manufacturing District will allow manufacturing and/or commercial uses.  This area is predominantly zoned for manufacturing.   This is one of the few remaining residentially zoned properties in this area.  Staff finds the current residential zoning to be unsuited to the area and supports this rezoning to the M, Manufacturing District because it will make the zoning and land uses consistent with the surrounding zoning and land uses.

WHEREAS, application #Z07-058 is on file with the Building Services Division of the Department of Development requesting rezoning of 19.1± acres from R, Rural District, to the M, Manufacturing District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested M, Manufacturing District will allow manufacturing and/or commercial uses.  This area is predominantly zoned for manufacturing.   This is one of the few remaining residentially zoned properties in this area.  Staff finds the current residential zoning to be unsuited to the area and supports this rezoning to the M, Manufacturing District because it will make the zoning and land uses consistent with the surrounding zoning and land uses, now, therefore:    
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
7250 STAR CHECK DRIVE (43217), being 19.1± acres located at the northwest corner of Fred Haise Avenue and Paul Tibbets Street, and being more particularly described as follows:
 
19.109 ACRES
(AT RICKENBACKER)
 
      Situate in the State of Ohio, County of Franklin, Township of Hamilton, Section 1, Township 3, Range 22, of the Congress Lands, and being all of the 19.109 acre tract conveyed to Columbus Regional Airport Authority by deed of record in Instrument Number ________________, record of the Recorder's Office, Franklin County, Ohio and being more particularly described as follows:
 
Beginning at an angle point in the existing City of Columbus Corporation Line as established by Ordinance Number 1386-97, of record in Instrument Number 199710070113498, marking the terminus point of the southerly right-of-way line of Port Road (fka Curtis Lemay Avenue) as designated and delineated on "Dedication of Curtis Lemay Avenue and Alum Creek Drive" of record in Plat Book 76, Page 46;
 
Thence the following three (3) courses and distances along the said 19.109 acre tract and southerly right-of-way line of said Port Road:
 
1.      South 86°09'45" East, a distance of 334.52 feet, to an angle point;
 
2.      South 86°10'39" East, a distance of 135.63 feet, to an angle point;
 
3.      South 87°54'46" East, a distance of 50.68 feet, to an angle point;
 
Thence the following eight (8) courses and distances along the lines of said 19.109 acre tract:
1.      Along an arc of a curve to the left having a central angle of 88°22'57", a radius of 50.00 feet, an arc length of 77.13, a chord bearing of South 47°53'46" West, with a chord distance of 69.71 feet to a point of tangency;
 
2.      South 03°42'17 " West, a distance of 904.56 feet, to an angle point;
 
3.      South 44°25'19" East, a distance of 419.53 feet, to an angle point;
 
4.      South 03°42'17" West, a distance of 434.99 feet, to an angle point;
 
5.      South 45°34'41" West, a distance of 140.07 feet, to an angle point;
 
6.      North 44°25'19" West, a distance of 976.73 feet, to an angle point;
 
7.      North 45°34'41" East, a distance of 53.87 feet, to an angle point;
 
8.      North 03°42'59" East, a distance of 1081.41 feet, to the Point of Beginning, containing 19.109 acres, more or less.
 
The bearings in the above description are based on the grid bearing of South 86° 13' 48" East, between Franklin County Geodetic Survey Monument Number 9958 and Franklin County Geodetic Survey Monument Number 9962.
 
To Rezone From: R, Rural District,
 
To: M, Manufacturing District
 
Section 2.  That a Height District of thirty-five (35) feet is hereby established on the M, Manufacturing District on this property.
 
Section 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division.
 
Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
