AN04-006
BACKGROUND:      This ordinance is submitted to present to Council the transcript of proceedings and papers relating to Annexation AN04-006 a certain petition for annexation as described in the ordinance and transcript which is attached hereto. More than sixty days have elapsed since May 4, 2004, the date of receipt from the Board of County Commissioners of Franklin County.
 
These are submitted in accordance with the Ohio Revised Code.
 
FISCAL IMPACT:      Provision of municipal services for a proposed annexation area has no fiscal impact.  However, provision of the stated services does represent cost to the city.  The annexation of land also has the potential to create revenue to the city.
 
Title
 
To accept the application (AN04-006) of Ralph P. Dematteo, et al for the annexation of certain territory containing 24.09 ± Acres in Franklin Township.
 
Body
 
WHEREAS,   a petition for the annexation of certain territory in Franklin Township was duly filed by Ralph P. Dematteo, et al on March 17, 2004; and
 
WHEREAS,  the said petition was duly considered by the Board of County Commissioners of  Franklin County, Ohio, and the annexation of said hereinafter described territory to the city of Columbus was approved by said Commissioners by order dated April 27, 2004; and
WHEREAS,  the Board of County Commissioners of  Franklin County certified the transcript of the proceedings in connection with the said annexation with the map and petition required in connection therewith to the City Clerk who received the same on May 4, 2004; and
WHEREAS,  sixty days from the date of said filing have now elapsed in accordance with the provisions of the Ohio Revised Code; and
 
WHEREAS,  it is in the best interest of the city of Columbus to accept the annexation of the territory sought to be annexed by the aforesaid petition; now, therefore,  
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
 
Section 1.  That the proposed annexation as applied for in the petition of Ralph P. Dematteo, et al being the majority of owner(s) of real estate in the territory sought to be annexed and filed with the Board of County Commissioners of Franklin County, Ohio March 17, 2004 in which said petition prayed for annexation to the city of Columbus, Ohio, of certain territory adjacent thereto as hereinafter described, and which said petition was approved for annexation to the city of Columbus by the Board of County Commissioners by order dated April 27, 2004, be and the same is hereby accepted and said territory is hereby annexed to the city of Columbus.  Said territory is described as follows:
 
Situated in the State of Ohio, County of Franklin, Township of Franklin, located in Virginia Military Survey No. 530 and No. 1279, being 24.09 acres consisting of 23.96 acres out of the 24.237 acre tract conveyed to Ralph P. Dematteo and John Dematteo in Deed Book 1704, Page 628 (Auditors Tax Parcel No. 140-000496) and a 0.13 acre portion of the roadway right-of-way of Hague Avenue within said Franklin Township (area of roadway right-of-way not within the said Dematteo tract), and being more particularly described as follows:
 
Commencing at a Point of Reference at the intersection of the centerline of said Hague Avenue with the centerline of La Vista Drive;
Thence northerly along the said centerline of Hague Avenue, a distance of 146 feet to a point at the southwesterly corner of the said Dematteo tract in the existing corporation line of the City of Columbus (Ordinance No. 1331-68, Miscellaneous Record 146-146);
 
Thence westerly, along the said existing corporation line, a distance of 20 feet to a point, being the Point of Beginning of the herein described area (approximately 24.09 acres) to be annexed to the said City of Columbus;
 
Thence northerly, continuing along the said existing corporation line, and along the existing corporation line of the City of Columbus with the westerly right-of-way line of Hague Avenue (Ordinance No. 1555-69, Miscellaneous Record 148-229), a distance of 286 feet to a point in the proposed corporation line of the City of Columbus;
 
Thence easterly, leaving the aforesaid existing corporation line and westerly right-of-way line, along the proposed corporation line of the City of Columbus, and through the right-of-way of said Hague Avenue, passing the said centerline of Hague Avenue and southwesterly corner of a 0.353 acre tract conveyed to Lloyd D. and Dianne Dalin in Official Record 13530, Page E19 (Auditors Tax Parcel No. 140-003284), hence along the southerly line of the said Dalin tract, a distance of 225 feet to a point at the southeasterly corner of the said Dalin tract;
 
Thence northerly, along the proposed corporation line of the city of Columbus, the easterly line of the said Dalin tract, the easterly line of a 0.353 acre tract conveyed to Debra L. Frazier in Instrument 200108020177489 (Auditors Tax Parcel No. 140-003285), and the easterly line of a 0.353 acre tract conveyed to Merle G. and Margaret L. Norris in Official Record 00106, Page A03 (Auditors Tax Parcel No. 140-006365), a distance of 225 feet to a point at the northeasterly corner of the said Norris tract;
 
Thence westerly, along the proposed corporation line of the City of Columbus, the northerly line of the said Norris tract, a distance of 185 feet to a point in the easterly right-of-way line of Hague Avenue;
 
Thence northerly, continuing along the aforesaid proposed corporation line of the City of Columbus, and along the said easterly right-of-way line of Hague Avenue, a distance of 228 feet to a point in the southerly line of a 0.241 acre tract conveyed to Larry M. and Sharon Williams in Deed Book 3367, Page 349 (Auditors Tax Parcel No. 140-002665);
 
Thence easterly, leaving the said easterly right-of-way line, continuing along the proposed corporation line of the City of Columbus, along the southerly line of the said 0.241 acre tract, the southerly line of a 0.339 acre tract conveyed to the said Larry M. and Sharon Williams in Deed Book 3367, Page 349 (Auditors Tax Parcel No. 140-004954), the southerly line of a 4.554 acre tract conveyed to Hubert and Helga Seifert in Official Record 08004, Page J07 (Auditors Tax Parcel No. 140-002920), and the southerly line of a 4 acre tract conveyed to Gary L. and Bonnie Watkinson in Deed Book 3436, Page 30 (Auditors Tax Parcel No. 140-004153), a distance of 1,364 feet to a point in the existing corporation line of the City of Columbus (Ordinance No. 1331-68, Miscellaneous Record 146-146) and the westerly line of a 16.784 acre tract conveyed to Kathryn Osborn in Official Record 30254, Page G12 (Auditors Tax Parcel No. 010-153761);
 
Thence southerly, along the aforesaid existing corporation line of the City of Columbus and the westerly line of the said Osborn tract, a distance of 768 feet to a point;
 
Thence westerly, along the aforesaid existing corporation line of the City of Columbus(Ordinance No. 1331-68, Miscellaneous Record 146-146), a northerly line of the said Osborn tract, the northerly line of a 7.409 acre tract conveyed to Wildwood Village III Limited Partnership in  Official Record 14431, Page B17 (Auditors Tax Parcel No. 010-122831), the northerly line of a 5.086 acre tract conveyed to Wildwood Village II Limited Partnership in Official Record 14431, Page B12 (Auditors Tax Parcel No. 010-110083), the northerly line of a 5.388 acre tract conveyed to Wildwood Village I Limited Partnership in Official Record 14431, Page B07 (Auditors Tax Parcel No. 010-102522), and through the said right-of-way of Hague Avenue, a distance of 1,618 feet to the Point of Beginning.
 
Containing 24.09 acres, more or less, consisting of 0.26 acres of present roadway right-of-way occupation by Hague Avenue.
 
Section 2.  That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.
 
Section 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
