Explanation

 

Council Variance Application:  CV22-083

 

APPLICANT:  Laura MacGregor Comek, Atty.; 17 South High Street, Suite 700; Columbus, OH 43219.  

 

PROPOSED USE:  Parking lot.   

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The applicant has received a recommendation of approval from Staff and the Development Commission for a concurrent rezoning request to the M, Manufacturing District (Ordinance #1038-2023; Z22-062) to maintain an existing parking lot for the John Glenn Columbus International Airport. The requested Council variance will conform existing site conditions and includes variances to landscaping and screening, maneuvering, and parking space requirements, some of which are necessary because the parking lot is comprised of parcels in two different taxing districts. Staff supports the variances as they are consistent with parking lots in the airport complex and will conform existing site conditions.

To grant a Variance from the provisions of Sections 3312.21(A)(B)(D), Landscaping and screening; 3312.25, Maneuvering; and 3312.29, Parking space, of the Columbus City Codes; for the property located at 1115 STELZER RD. (43219), to permit reduced development standards for a parking lot in the M, Manufacturing District (Council Variance #CV22-083).

 

Body

 

WHEREAS, by application #CV22-083, the owner of property at 1115 STELZER RD. (43219), is requesting a Council variance to permit reduced development standards for a parking lot in the M, Manufacturing District; and

 

WHEREAS, Section 3312.21(A)(B)(D), Landscaping and screening, requires that interior parking lot trees shall be planted in landscaped islands or peninsulas containing a minimum soil area of 145 square feet with a minimum radius of 4 feet per tree; that screening be provided for parking lots located within 80 feet of residentially zoned property within a landscaped area at least 4 feet in width; and that headlight screening be provided along public streets within a landscaped area at least 4 feet in width, while the applicant proposes no landscaping and screening, conforming existing conditions, as demonstrated on the submitted site plan; and

 

WHEREAS, Section 3312.25, Maneuvering, requires sufficient maneuvering area on the parcel for the parking spaces for which it serves, while the applicant proposes parking spaces to maneuver over parcel lines as the parcels cannot be combined due to their tax identification numbers, but will provide the minimum maneuvering area; and

 

WHEREAS, 3312.29, Parking space, requires 90-degree parking spaces to be no less than 9 feet wide by 18 feet deep, while the applicant proposes parking spaces that are 8.5 feet wide by 18 feet deep that may be divided by parcel lines as the parcels cannot be combined due to their tax identification numbers, but will meet the minimum parking space dimensions established by this ordinance; and

 

WHEREAS, the City Departments recommend approval because the requested variances will conform existing conditions of an existing parking lot which is consistent with parking lots in the airport complex; and

 

WHEREAS, said ordinance requires separate submission for all applicable permits and a Certificate of Zoning Clearance for the existing parking lot; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public roads, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 1115 STELZER RD. (43219), in using said property as desired, now therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That variances from the provisions of Sections 3312.21(A)(B)(D), Landscaping and screening; 3312.25, Maneuvering; and 3312.29, Parking space, of the Columbus City Codes; for the property located at 1115 STELZER RD. (43219), insofar as said sections prohibit no landscaping and screening; maneuvering over parcel lines; and parking spaces that are 8.5 feet wide by 18 feet deep and are divided by parcel lines; said property being more particularly described as follows:

 

1115 STELZER RD. (43219), being 35.17± acres located at the northwest corner of Stelzer Road and East Seventeenth Avenue, and being more particularly described as follows:

 

Situated in State of Ohio, County of Franklin, City of Columbus on the west side of Stelzer Road between Seventeenth Avenue and Airport Road. Said land being also situated in Quarter Township 3, Township 1 North, Range 17 West, U. S. Military Lands, (all references to deeds, microfiche, plats, surveys, etc. refer to the records of the Franklin County Recorder’s Office, unless noted otherwise) and being more particularly bounded and described as follows:

 

The POINT OF BEGINNING is the northeast corner of Seventeenth Avenue, recorded in Road Record 16, Page 233 and Ethel Avenue (unimproved), recorded in Plat Book 19, Page 35 and the southwest corner of an 8.91 acre tract of land conveyed to Columbus Municipal Airport Authority:

 

thence along the said east right of way of Ethel Avenue, the west line of said 8.91 acre tract and the line between Mifflin Township and the City of Columbus, North four degrees twenty-six minutes three seconds East (N04°26'03"E), for seven hundred twenty-two and 79/100 feet (722.79') to the northwest corner of said 8.91 acre tract and the south line of a 1.36 acre tract of land conveyed to State of Ohio, PID 190-000136;

 

thence continuing along said township and city line and said south line, north line of said 8.91 acre tract, south line of a 2.36 acre tract of land conveyed to State of Ohio, PID 190-000213 and a south line of a 128.640 acre tract of land conveyed to Columbus Municipal Airport Authority, PID 010-146775, South eighty-six degrees fifteen minutes fifty-eight seconds East (S86°15'58"E), for five hundred forty-three and 74/100 feet (543.74') to a south corner of said PID 010-146775;

 

thence along a west line of said PID 010-146775, South four degrees twenty-six minutes two seconds West (S04°26'02"W), for seventeen and 06/100 feet (17.06')

 

thence leaving said line and across said PID 010-146775 for the following four (4) courses:

 

1.                     South eighty-five degrees thirty-three minutes six seconds East (S85°33'06"E), for six hundred five and 75/100 feet (605.75');

 

2.                     South eighty-three degrees thirty-two minutes fifty-three seconds East (S83°32'53"E), for five hundred seventy-one and 93/100 feet (571.93');

Thence leaving said Deed Book 2632, Page 575 line, along said right of way, south line of said PID 010-146775 and south line of said 8.91 acre tract, North eighty-six degrees twenty-three minutes thirteen seconds West (N86°23'13"W), for one thousand eight hundred seventy-five and 94/100 feet (1,875.94') to the POINT OF BEGINNING, containing 35.170 acres, more or less, subject however to all covenants, conditions, restrictions, reservations, and easements contained in any instrument of record pertaining to the above described tract of land.

 

Iron pins set are 5/8" rebar, 30" in length, with a plastic plug placed on top inscribed with the name "WOOLPERT INC", unless otherwise noted. All monuments found are in good condition unless otherwise noted.

 

Bearings are based upon the Ohio State Plane Coordinate System, South Zone, NAD83 (1995).

 

SECTION 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for those uses permitted in the M, Manufacturing District.  

 

SECTION 3.  That this ordinance is further conditioned on the subject site being developed in general conformance with the exhibits titled,NEW EMPLOYEE AND 17TH AVENUE PARKING LOTS - SHEETS 1-2,” dated August 23, 2022, and signed by Laura MacGregor Comek, Attorney for the Applicant. The plans may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development and when engineering and architectural drawings are completed. Any slight adjustments to the plans shall be subject to review and approval by the Director of the Department of Building and Zoning Services, or a designee, upon submission of the appropriate data regarding the proposed adjustment.

 

SECTION 4.  That this ordinance is further conditioned on the applicant obtaining all applicable permits and a Certificate of Zoning Clearance for the existing parking lot.

 

SECTION 5.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
