Explanation

 

Background:  The City’s Recreation and Parks Department (CRPD) manages real property located at 276 South Nelson Road, Columbus, Ohio 43205 {Franklin County Tax Parcel 010-008432} and commonly known as Academy Park. The City of Bexley, Ohio, an Ohio municipal corporation acting through its Recreation and Parks Department (“Bexley”), Bexley City Schools, an Ohio school district and political subdivision organized pursuant to Ohio Revised Code, Chapter 3311 (“BCS”), and Capital University, an Ohio nonprofit corporation (“Capital”), desire to lease certain portions of Academy Park commonly known as Clowson Field (“Premises”) to operate public academic and competitive athletic programs (“Program”).

 

Bexley, BCS, and Capital request to lease the Premises for twenty (20) years. CRPD reviewed Bexley, BCS, and Capital’s request and supports leasing the Premises in consideration of (i) a nominal payment of Thirty and 00/100 U.S. Dollars ($30.00), (ii) operating the Program, and (iii) making certain improvements to Premises pursuant to CRPD’s written authorization.

 

Contract Compliance:                      Not applicable.

 

Fiscal Impact:  Compensation from Bexley, BCS, and Capital will be deposited in Columbus Recreation and Parks Department Permanent Improvement Fund, Fund Number 747, OCA Number 747999.

To authorize and direct the Director of the Columbus Recreation and Parks Department to execute and acknowledge any necessary document(s), as approved by the Columbus City Attorney, in order to lease certain portions of Academy Park to the City of Bexley, Bexley City Schools, and Capital University to enter into lease agreements with certain nonprofit boating organizations to operate public academic and competitive athletic programs. Body

 

WHEREAS, the City intends to lease the Premises to Bexley, BCS, and Capital for a duration of twenty (20) years; and

 

WHEREAS, the City intends to lease the Premises to Bexley, BCS, and Capital in consideration of (i) a nominal payment of Thirty and 00/100 U.S. Dollars ($30.00), (ii) operating the Program, and (iii) making certain improvements to Premises pursuant to CRPD’s written authorization; and

 

WHEREAS, the City intends for the City Attorney to preapprove all instrument(s) executed by City personnel pursuant to authority granted by this ordinance; and

 

WHEREAS, it has become necessary in the usual daily operation of the Recreation and Parks Department to authorize the Director to execute any necessary documents to enter into said lease;  NOW THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS, OHIO:

 

SECTION 1.                     The City’s director of the Recreation and Parks Department (CRPD) is authorized to execute and acknowledge any document(s) necessary to lease the portions of Academy Park described and depicted in the one (1) page attachment, Exhibit-A, which is fully incorporated for reference as if rewritten (i.e. Premises), to the City of Bexley, Ohio, an Ohio municipal corporation acting through its Recreation and Parks Department (i.e. Bexley), Bexley City Schools, an Ohio school district and political subdivision organized pursuant to Ohio Revised Code, Chapter 3311 (i.e. BCS), and Capital University, an Ohio nonprofit corporation (i.e. Capital), in order to nonexclusively use, operate, maintain, and manage public academic and competitive athletic programs (i.e. Program).

 

SECTION 2.                     Bexley, BCS, and Capital are permitted to lease the Premises for duration of no more than twenty (20) years. 

 

SECTION 3.                     The City’s receipts of all consideration, compensation, and fees from leasing the Premises to Bexley, BCS, and Capital will be deposited with the Recreation and Parks Permanent Improvement Fund, Fund Number 747, OCA Number 747999.

 

SECTION 4.                     The City Attorney is required to preapprove all instrument(s) executed by the director of CRPD pursuant to this ordinance. 

 

SECTION 5.                     That this ordinance shall take effect and be in force from and after the earliest period allowable by law.
