Council Variance Application CV23-094

 

APPLICANT: Deonte Holder; c/o Brenda Parker, Agent; 405 North Front Street; Columbus, OH 43215.

 

PROPOSED USE: Two-unit dwelling.

 

MIDEAST AREA COMMISSION RECOMMENDATION: Approval.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval. The site is currently undeveloped in the R-2, Residential District. The requested Council variance will allow for the construction of a two-unit dwelling. A Council variance is required because the R-2 district only allows one single-unit dwelling per lot as residential uses. The site is located in an area that does not have a Council adopted land use plan. Approval of this request will not add new or incompatible uses to the area. Staff supports the requested variance as it will allow the site to be improved with a two-unit dwelling, consistent with the surrounding development pattern.

To grant a Variance from the provisions of Section 3332.033, R-2 residential district, of the Columbus City Codes; for the property located at 2970 ASKINS RD. (43232), to allow a two-unit dwelling in the R-2, Residential District (Council Variance #CV23-094).

 

Body

 

WHEREAS, by application #CV23-094, the owner of property at 2970 ASKINS RD. (43232), is requesting a Council variance to allow a two-unit dwelling in the R-2, Residential District; and

 

WHEREAS, Section 3332.033, R-2 residential district, lists single-unit dwellings as the only allowable residential use, while the applicant proposes to construct a two-unit dwelling; and

 

WHEREAS, the Mideast Area Commission recommends approval; and

 

WHEREAS, the City Departments recommend approval because the requested variance will allow the site to be improved with a two-unit dwelling which is consistent with the development pattern of the surrounding neighborhood; and

 

WHEREAS, said ordinance requires separate submission for all applicable permits and Certificate of Occupancy for the proposed two-unit dwelling; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to the adjacent property, unreasonably increase the congestion of public streets, increase the danger of fires, endanger the public safety, unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety, comfort, morals or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owner of the property located at 2970 ASKINS RD. (43232), in using said property as desired; now, therefore;

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That a variance from the provisions of Section 3332.033, R-2 residential district, of the Columbus City Codes, is hereby granted for the property located at 2970 ASKINS RD. (43232), insofar as said section prohibits a two-unit dwelling in the R-2, Residential District; said property being more particularly described as follows:

 

2970 ASKINS RD. (43232), being 0.26± acres located on the east side of Askins Road, at the terminus of Mathena Way, and being more particularly described as follows:

 

Situated in the State of Ohio, County of Franklin, and the City of Columbus:

 

PARCEL “A”

 

Being a parcel of land situated in Lot Number Ten (10), Twilight Farms Subdivision, Section 5, Township 11, Range 21, Madison Township, Franklin County, Ohio and being more particularly described as follows:

 

Beginning at an iron pin found marking the northwesterly corner of said Lot Number Ten (10), Twilight Farms Subdivision as recorded in Plat Book 19, Page 6 in the Franklin County Recorder’s Office;

 

Thence South 08°16’18” West along the westerly line of said Lot Number Ten (10), said westerly line also being the easterly Right-of-Way line of Askins Road, a distance of 94.00 feet to a point:

 

Thence South 82°06’24” East along a line parallel to the northerly line of said Lot Number Ten (10), a distance of 120.00 feet to a point:

 

Thence North 08°16’18” East along a line parallel to the westerly line of said Lot Number Ten (10), a distance of 94.00 feet to a point on the northerly line of said Lot Number Ten (10):

 

Thence North 82°06’24” West along the northerly line of said Lot Number Ten (10), a distance of 120.00 feet to the POINT OF BEGINNING, containing 0.259 acres of land, more or less.

 

The bearings referred to herein are based on the centerline of Askins Road having an assumed bearing of North 08°16’18” East, as delineated upon the Remington Ridge Plat (Section 3, Part 2) recorded in Plat Book 90, Page 5 on file at the Franklin County Recorder’s and are shown only for the purpose of determine angular measurements.

SECTION 2. That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for a two-unit dwelling, or those uses permitted in the R-2, Residential District.

 

SECTION 3. That this ordinance is further conditioned on the Subject Site being developed in general conformance with the site plan titled, "SITE PLAN," and building elevations titled, "EXTERIOR ELEVATIONS," both dated January 16, 2024, and signed by Brenda Parker, Agent for the Applicant. The plans may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development and when engineering and architectural drawings are completed. Any slight adjustments to the plans shall be subject to review and approval by the Director of the Department of Building and Zoning Services, or a designee, upon submission of the appropriate data regarding the proposed adjustment.

 

SECTION 4. That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed two-unit dwelling.

 

SECTION 5. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
