Explanation

 

BACKGROUND:  The need exists to amend Ordinance No. 3288-2023, passed by Columbus City Council on December 4, 2023, which authorized the Director of the Department of Public Safety to enter into contract with The Research Foundation of the City University of New York on behalf of the National Network for Safe Communities (NNSC) at John Jay College to work directly with the Columbus Violence Reduction (CVR) team and other Columbus officials and community leaders to advance the Group Violence Intervention (GVI) implementation and strengthen police legitimacy.

An amendment is now required to revise the term of the contract.  Ordinance No. 3288-2023 listed the term of the contract as October 4, 2023 through August 31, 2024.  Due to delays in executing the contract, there is a need to amend the term to begin on October 4, 2023 and end one year after the contract signing or execution by both parties.

 

Term: The agreement shall be for the period covering October 4, 2023 and ending August 31, 2024.  The Agreement shall be for a period beginning October 4, 2023 and ending one year after the contract signing or execution by both parties. This Agreement shall not automatically renew

Fiscal Impact:  $59,700.00 is encumbered on ACPO009900.  The ACPO should be updated to reflect the new ordinance number.

Emergency action is requested so that a contract can be entered into immediately and project activities can begin without delay.

WHEREAS, the need exists to amend Ordinance No. 3288-2023, which was approved by Columbus City Council on December 4, 2023; and

WHEREAS, Ordinance No. 3288-2023 listed the term of the contract as October 4, 2023 through August 31, 2024; and,

WHEREAS, due to delays in executing the contract, it is necessary to amend the term of the contract to begin on October 4, 2023 and end one year after the contract signing or execution by both parties; and,

 

WHEREAS, it is necessary to update ACPO009900 to reflect this new ordinance number; and,                                                                                                                                                                                                                                                             

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Safety in that it is immediately necessary to amend Ordinance No. 3288-2023, passed by Columbus City Council on December 4, 2023, to revise the contract term, so that project activities can begin without delay, for the immediate preservation of the public health, peace, property, safety and welfare; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

SECTION 1.  That the Background Section of Ordinance No. 3288-2023 is hereby amended to revise the contract term as follows, with additions in underline and deletions in strikethrough:

SECTION 2.  That the Background Section of Ordinance No. 3288-2023 is hereby repealed.

 

SECTION 3.  That ACPO009900 will remain in place and will be updated to reflect this ordinance number.

 

SECTION 4. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 5. That the monies appropriated in Ordinance 3288-2023 shall be paid upon the order of the Director of the Department of Public Safety, and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.

 

SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 7. That for the reasons stated in the preamble hereto, which is hereby made a part thereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
