BACKGROUND: The purpose of this ordinance is to amend ordinance 3072-2024, which authorized the purchase of drones, software, and accessories from a Universal Term Contract with Axon Enterprise Inc. Instead, the Division of Police requests to waive the competitive bidding provisions of the Columbus City Code and award a contract to Axon Enterprise Inc for the purchase of drones, software, and accessories. This is necessary because it was determined that the drones, software, and accessories are not a part of the Universal Term Contract and cannot be added.
This ordinance amends Ordinance 3072-2024, which was passed by City Council on December 16, 2024.
Bid Information: The Division of Police requests to waive the competitive bidding provisions of the Columbus City Code in order to keep within the same technology configuration and allow for seamless integration with other Axon devices in use by the Division. WHEREAS, Ordinance 3072-2024, passed on December 16, 2024, authorized the purchase of drones and accessories from the Universal Term Contract with Axon Enterprise Inc.; and
WHEREAS, it was later determined that the drones and accessories were not a part of the Universal Term Contract and cannot be added; and
WHEREAS, it is necessary to amend Ordinance 3072-2024, passed on December 16, 2024, to allow for the contract for the purchase of Drones, Software, and Accessories for the Division of Police to be awarded to Axon Enterprise Inc; and
WHEREAS, it is in the best interest of the City of Columbus to waive competitive bidding for this purchase in order to keep within the same technology configuration and allow for seamless integration with other Axon devices in use by the Division of Police; and
WHEREAS, it is necessary to update ACPR002994 to reflect this new ordinance number; and
WHEREAS, it has become necessary in the usual daily operation of the Department of Public Safety to amend Ordinance 3072-2024 to authorize the Director to enter into a contract with Axon Enterprise Inc for the purchase of Drones, Software, and Accessories, for the preservation of the public safety, health, peace, property, and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That Ordinance 3072-2024 is hereby amended to remove references to the Universal Term Contract and instead authorize a contract with Axon Enterprise Inc through the waiver of the competitive bidding provisions of Chapter 329 of the Columbus City Code, with additions in underline and deletions in strikethrough:
Title: To authorize the Finance and Management Director to associate all general budget reservations resulting from this ordinance with the appropriate Universal Term Contract Purchase Agreement with Axon Enterprise Inc enter into contract with Axon Enterprise Inc for the purchase of Drones, Software, and Accessories for the Division of Police; to waive the competitive bidding provisions of Columbus City Code Chapter 329; and to authorize the expenditure of $172,000.00 from the Law Enforcement Contraband Fund. ($172,000.00)
WHEREAS, the Purchasing Office advertised and solicited formal bids and selected the highest ranked bidder to negotiate a contract for the Columbus Division of Police; and
WHEREAS, it is necessary to authorize the Finance and Management Director to associate all general budget reservations resulting from this ordinance with the appropriate Universal Term Contract Purchase Agreements amend Ordinance 3072-2024, passed on December 16, 2024, to allow for the contract for the purchase of Drones, Software, and Accessories for the Division of Police to be awarded to Axon Enterprise Inc; and now, therefore:
SECTION 1. That the Finance and Management Director is hereby authorized to associate all general budget reservations resulting from this ordinance with the appropriate Universal Term Contract enter into contract with Axon Enterprise Inc for the purchase of Drones, Software, and Accessories for the Columbus Division of Police.
SECTION 2. That the Title, Second and Third WHEREAS clauses, and Section 1 of Ordinance 3072-2024 are hereby repealed.
SECTION 3. That ACPR002994 will remain in place and will be updated to reflect this ordinance number.
SECTION 4. That the Finance and Management Director is hereby authorized to enter into contract with Axon Enterprise Inc for the purchase of Drones, Software, and Accessories for the Columbus Division of Police.
SECTION 5. That this Council finds it in the best interest of the City of Columbus to waive the competitive bidding provisions of Chapter 329 of the Columbus City Code to permit the aforementioned purchase.
SECTION 6. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 7. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance and to make any accounting changes necessary to ensure that this contract is properly accounted for and recorded accurately on the City's financial records.
SECTION 8. This ordinance shall take effect and be in force from and after the earliest period allowed by law.
