Explanation

1.  BACKGROUND

The purpose of this ordinance is to amend Ordinance 0229-2017 in order to accurately reflect the cost splits of the Arterial Street Rehabilitation - Hamilton Road - I70 to Refugee Road (FRA-SR317-10.630 (PID Number 95570)) project.  Ordinance 0229-2017 incorrectly identified Federal Funds as the sole funding source when City of Columbus Bond Funds will also be utilized.  

 

Legislation 0229-2017 authorized the City Attorney's Office, Real Estate Division, to hire professional services and to negotiate with property owners to acquire the various property rights necessary to complete the Arterial Street Rehabilitation - Hamilton Road - I70 to Refugee Road (FRA-SR317-10.630 (PID Number 95570)) project. 

 

This amendment is requested because the funding as originally listed in the accounting templates by the Department of Public Service did not include the funding contribution required from the Department of Public Service.  It is necessary to correct the accounting template to state the following funding sources: the Federal Transportation Grants Fund in the amount of up to $1,628,888.89; and the Streets and Highways Bond Fund in the amount of up to $371,111.11.

 

2.  FISCAL IMPACT

This is a reimbursable budgeted expense of $1,628,888.89 for this project within the Federal Transportation Grants Fund (Fund 7765).  Funds in the amount of $371,111.11 were budgeted and are available within the Streets and Highways Fund (Fund 7704) for this project. 

 

3.  EMERGENCY DESIGNATION

Emergency action is requested to allow compliance with the grant terms and conditions as quickly as possible.

Body

WHEREAS, Ordinance 0229-2017 authorized the City Attorney's Office, Real Estate Division, to hire professional services and to negotiate with property owners to acquire the various property rights necessary to complete the Arterial Street Rehabilitation - Hamilton Road - I70 to Refugee Road (FRA-SR317-10.630 (PID Number 95570)) project; and

 

WHEREAS, the funding source for Ordinance 0229-2017 charged all acquisitions to a grant and omitted the required local share contribution; and

 

WHEREAS, it is necessary to amend the original legislation to add the required local match funding; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the above actions to allow compliance with the grant terms and conditions as quickly as possible, thereby preserving the public health, peace, property, safety and welfare; now therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That Ordinance 0229-2017 be and hereby is amended as follows:

(title)

To authorize the City Attorney's Office, Real Estate Division, to contract for professional services relative to the acquisition of fee simple title and lesser interests in and to property needed for the Arterial Street Rehabilitation - Hamilton Road - I-70 to Refugee Road project; to authorize the Director of Public Service to enter into any necessary agreements to accept Federal earmarked funds for said project; to authorize the City Attorney's Office, Real Estate Division, to negotiate with property owners to acquire the additional rights of way necessary to complete this project; to authorize the expenditure of up to $2,000,000.00 from the Federal Transportation Grants Fund and the Streets and Highways Bond Fund; and to declare an emergency.  ($2,000,000.00)

 

(fiscal impact)

Funds in the amount of $2,000,000.00 $1,628,888.89 are available for this project within the Federal Transportation Grants Fund (Fund 7765) and funds in the amount of $371,111.11 are available within the Streets and Highways Bond Fund (Fund 7704) within the Department of Public Service.

SECTION 3.  That from the unappropriated monies and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ended December 31, 2017, the sum of $2,000,000.00 $1,628,888.89 is appropriated in the Federal Transportation Grants Fund, Fund 7765 in object class 06 Capital Outlay per the account codes in the attachment to this ordinance.

SECTION 4.  That the expenditure of $2,000,000.00$1,628,888.89, or so much thereof as may be needed, is hereby authorized in the Federal Transportation Grants Fund, Fund 7765 in object class 06 Capital Outlay per the accounting codes in the attachment to this ordinance.

SECTION 5.  That the expenditure of $371,111.11, or so much thereof as may be needed, is hereby authorized in Fund 7704 (Streets and Highways Bond Fund), Dept-Div 5912, Project P530103-100052 (Arterial Street Rehabilitation - Hamilton Road - I70 to Refugee Road) in object class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.

SECTION 56.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated and the City Auditor shall establish such accounting codes as necessary.

 

(section 6)

SECTION 67.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

(section 7)

SECTION 78.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

(section 8)

SECTION 89.  That at the end of the grant (Federal earmark) period, any repayment of unencumbered balances required by the grantor is hereby authorized and any unused City match monies may be transferred back to the City fund from which they originated in accordance with all applicable grant agreements.

 

(section 9)

SECTION 910.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
