Explanation
 
BACKGROUND:  This ordinance authorizes a transfer of funds within the Division of Police General Fund operating budget for the purchase of one-hundred Smith and Wesson M&P full size .40 caliber semi-automatic pistols for two new recruit classes.  A recruit class will begin in June 2011 and the second class will begin in December 2011.  The funds for the purchase of the pistols was budgeted in the transfer category within the Police General Fund 2011 operating budget.  Therefore, funds need to be transferred from Object Level (1) 10 to Object Level (1) 02 in order to purchase these pistols for the two recruit classes.
 
Bid Information:   Formal Bid # SA003939 was opened on May 5, 2011.   Two responses were received as follows:
 
Vance Outdoors             $36,890.00
Standard Law             $37,500.00
 
Both bidders are majority business entities.
 
Based on the lowest, most responsive and best bid received, the Division of Police recommends the award to Vance Outdoors, Inc.
 
This company is not debarred according to the Federal excluded parties listing or prohibited from being awarded a contract according to the Auditor of State unresolved findings for recovery certified search.
 
Contract Compliance Number: 542072038, expires 1-06-2012.
 
EMERGENCY DESIGNATION: Emergency legislation is requested so that the pistols can be supplied to recruits that are expected to start in June 2011.
 
FISCAL IMPACT:   This ordinance authorizes the purchase of one-hundred Smith and Wesson semi- automatic pistols from Vance Outdoors Inc., in the amount of $36,890.00 from the General Fund operating budget of the Division of Police. These funds were budgeted in Object Level (1) 10 of the Division's 2011 General Fund Budget.  The Police purchased eighty pistols in 2008 for  $31,877.60.

WHEREAS, a formal bid opening was held on May 5, 2011 for the purchase of semi-automatic pistols; and
 
WHEREAS, the Division of Police, Department of Public Safety needs to enter into a contract for the purchase of semi-automatic pistols for its recruit classes; and
 
WHEREAS, Vance Outdoors, Inc. was the lowest, most responsive, and best bid received; and
 
WHEREAS, funds need to be transferred within the Division of Police's General Fund Budget; and
 
WHEREAS, an emergency exists in the usual and daily operation of the Division of Police, Department of Public Safety, in that it is immediately necessary to purchase these semi-automatic pistols for police recruits for the immediate preservation of the public peace, health, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1. That the Director of Finance and Management be and is hereby authorized and directed to enter into a contract with Vance Outdoors, Inc. for the purchase of semi-automatic pistols for the Division of Police, Department of Public Safety, based on the above vendor bid being the lowest and best bid received.
 
SECTION 2.That funds in the Division of Police's General Fund Budget, Div 30-03, Fund 010 be transferred as follows:
