NORTH CENTRAL AREA COMMISSION RECOMMENDATION: Approval.
CITY DEPARTMENTS' RECOMMENDATION: Approval. The 10.18± acre site consists of two parcels. The southern parcel is developed with a religious facility in the R-2, Residential District. The northern parcel is undeveloped in the R, Rural District. The requested AR-1, Apartment Residential District will allow a multi-unit residential development. The site is within the planning boundaries of the North Central Plan (2002), which recommends the “Parkland” land uses at this location. While the proposal is inconsistent with the “Parkland” recommendation, staff notes that a previous Council Variance (Ordinance #2129-2023; CV23-022) was approved for this site, proposing a 220-unit apartment complex for an affordable housing project which did not come to fruition. The proposed use is also consistent with the City’s objective of creating more housing in all areas of the city. Concurrent Council Variance (Ordinance #1602-2025; CV24-158) has been filed in conjunction with this rezoning, and includes variances to reduce parking setback lines, building lines, and perimeter yard for a proposed 196-unit apartment complex across three buildings. Staff recognizes that the commitments and site design included in concurrent CV24-158 are additional mitigating factors for support of this rezoning request.

WHEREAS, application #Z24-070 is on file with the Department of Building and Zoning Services requesting rezoning of 10.18± acres from R-2, Residential District, and R, Rural District, to the AR-1, Apartment Residential District; and
WHEREAS, the Development Commission recommends approval of said zoning change; and
WHEREAS, the North Central Area Commission recommends approval of said zoning change; and
WHEREAS, the City Departments recommend approval because, while the proposal is inconsistent with the “Parkland” land use recommendation of the North Central Plan at this location, staff notes that the site is subject to Council Variance #CV23-022, allowing a 220-unit apartment complex, and recognizes that the commitments and site design included in concurrent CV24-158 are additional mitigating factors for support of this rezoning request. The proposed use is also consistent with the City’s objective of creating more housing in all areas of the city; now, therefore:

SECTION 1. That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

SECTION 2. That a Height District of sixty (60) feet is hereby established on the AR-1, Apartment Residential District on this property.
SECTION 3. That the Director of the Department of Building and Zoning Services be, and is hereby authorized and directed to make the said changes on the said official zoning map in the office of the Department of Building and Zoning Services.
SECTION 4. That the traffic-related commitments for this proposal have been established and are contained in the commitments for Council Variance #CV24-158; Ordinance #1602-2025.
SECTION 5. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
