Explanation
The City has a contract for food concessions with Ricardo's Restaurant, Inc. at Mentel and Champions Golf Courses currently in its first year renewal option (2011). The original Ord. # is 1677-2007 passed Nov. 26, 2007. The contract ended December 31, 2010 and has one additional renewal option for 2012.
The City and Concessionaire agree to modify their existing contract as follows:
1. The established annual rent shall be decreased by $8,700 for 2011 and 2012 for a total annual payment of $78,300 for 2011 and $79,300 for 2012.
2. Ricardo's Restaurant, Inc. will pay an additional fifteen (15) percent on any net sales in excess of $290,000.00 in 2011; the same will be for 2012 should Ricardo's Restaurant, Inc. and the Recreation and Parks Department agree to renew the contract.
3. All other terms and conditions remain the same for Mentel and Champions Food Concessions by Ricardo's Restaurant, Inc.

To authorize and direct the Director of Recreation and Parks to modify the food concession contract, CT01156R, at Mentel and Champions Golf Courses with Ricardo's Restaurant, Inc.; and to declare an emergency.
Body
WHEREAS, it is necessary to modify the contract with Ricardo's Restaurant, Inc, for concession operations at Mentel Memorial and Champions Golf Courses; and
WHEREAS, the annual rent shall be decreased by $8,700 for 2011 and 2012 for a total annual payments of $78,300 for 2011 and $79,300 for 2012; and
WHEREAS, Ricardo's Restaurant, Inc. will pay an additional 15 percent on any net sales in excess of $290,000.00 in 2011; the same will be for 2012 should Ricardo's Restaurant, Inc. and the Recreation and Parks Department agree to renew the contract; and
WHEREAS, all other terms and conditions remain the same for Mentel and Champions Food Concessions by Ricardo's Restaurant, Inc; and
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to modify said revenue generating contract so that Ricardo's Restaurant can move forward with event scheduling and marketing plans; NOW, THEREFORE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Recreation and Parks be and he is hereby authorized to modify the contract with Ricardo's Restaurant, Inc, for concession operations at Mentel Memorial and Champions Golf Courses.
SECTION 2. That the annual rent shall be decreased by $8,700 for 2011 and 2012 for a total annual payment of $78,300 for 2011 and $79,300 for 2012.
SECTION 3. That Ricardo's Restaurant, Inc. will pay an additional 15 percent on any net sales in excess of $290,000.00 in 2011; the same will be for 2012 should Ricardo's Restaurant, Inc. and the Recreation and Parks Department agree to renew the contract.
SECTION 4. All other terms and conditions remain the same for Mentel and Champions Food Concessions by Ricardo's Restaurant, Inc.
SECTION 5. Revenue funds will be paid to Golf Course Operations Fund 284; Department 51-03; revenue OCA codes 025841-Mentel Golf Course and 025932-Champions Golf Course.
SECTION 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or 10 days after passage if the Mayor neither approves nor vetoes the same.
