Title: To authorize the Director of the Public Service Department to execute those documents required to grant an encroachment easement for a ramp that will provide ADA compliant access to the building located at 2439 North High Street.
Explanation
 
As a part of the continuing effort to bring City sidewalks into compliance with ADA standards, the Public Service Department, Transportation Division, recently installed an ADA compliant ramp at the southwest corner of Blake Avenue and North High Street.  As a result of the installation of the compliant ramp the sidewalk adjacent to the building located at 2439 North High Street was lowered and the building was no longer ADA accessible.  The proprietor of the business located in this building is physically challenged and requires ADA compliant access to this building.  To provide the necessary access the City installed a fully compliant ramp into this building and would now like to grant an encroachment easement for this ramp to George Margetis.

WHEREAS, the City of Columbus, Public Service Department, Transportation Division, recently installed an ADA compliant ramp at the southwest corner of Blake Avenue and North High Street; and
 
WHEREAS, as a result of the installation of the compliant ramp the sidewalk adjacent to the building located at 2439 North High Street was lowered and the building was no longer ADA accessible; and
 
WHEREAS, the proprietor of the business located in this building is physically challenged and requires ADA compliant access to this building; and
 
WHEREAS, to provide the necessary access the City installed a fully compliant ramp into this building and would now like to grant an encroachment easement for this ramp to George Margetis; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of the Public Service Department be and is hereby authorized to execute those documents necessary to grant the following described encroachment easement to George Margetis; to-wit:
 
Situate in the State of Ohio, County of Franklin, City of Columbus, Quarter Township 3, Township 1 North, Range 18 West, United States Military Lands and being a strip of land on, over, or through the right-of-way of North High Street and being more particularly described as follows:
Beginning at the intersection of the southerly right-of-way line of Blake Avenue with the westerly right-of-way line of North High Street, said point being the northeasterly corner of Lot 2 of MONTGOMERY AND MCKEE'S AMENDED AND CORRECTED PLAT of Laura Maynard Knickerbocker's Second Subdivision to the City of Columbus of record in Plat Book 5, Pages 102 & 103, Recorder's Office, Franklin County, Ohio and said point being also at the northeasterly corner of that portion of the said Lot 2 as conveyed to George Margetis by deed of record in Official Record 1555E10, Recorder's Office, Franklin County, Ohio;
Thence through the right-of-way of said North High Street by the following described four (4) courses:
(1)      North 10 degrees 13 minutes 46 seconds West, a distance of 0.45 feet to a point;
(2)      North 81 degrees 24 minutes 02 seconds East, a distance of 4.31 feet to a point;
(3)      South 9 degrees 49 minutes 18 seconds East, a distance of 12.78 feet to a point;
(4)      South 78 degrees 52 minutes 17 seconds West, a distance of 4.22 feet to a point in the westerly right-of-way line of said North High Street and said point being also in the easterly line of said Lot 2;
Thence North 10 degrees 13 minutes 46 seconds West, a distance of 12.52 feet along the westerly right-of-way line of said North High Street and also along the easterly line of said Lot 2 to the Point of Beginning, containing 0.001 acres, more or less.
