Explanation
Background: The City of Columbus, Ohio is the holder of a certain sanitary sewer easement by virtue of a recorded deed of easement. Carlisle V. Perry has requested the City release the aforementioned sanitary sewer easement in exchange for a previously granted replacement easement. After investigation, it has been determined that the proposed exchange of easements will not adversely affect the City and therefore should be granted. The following legislation authorizes the Director of the Department of Public Utilities to execute those instruments necessary to release the aforementioned sanitary sewer easement at no charge.

Title
To authorize the Director of the Department of Public Utilities to execute those instruments necessary to release a sanitary sewer easement on the behalf of Carlisle V. Perry in exchange for a replacement easement previously granted to the City of Columbus, Ohio.

WHEREAS, the City of Columbus, Department of Public Utilities, is the owner of a sanitary sewer easement by virtue of recorded instrument 199904300109186 in the Franklin County Recorders Office; and
WHEREAS, Carlisle V. Perry, has requested that the aforementioned sanitary sewer easement be released, at no charge in exchange for a replacement easement previously granted to the City of Columbus; and
WHEREAS, the Division of Sewerage & Drainage, after investigation, has determined that the release of said easement rights will not adversely affect the operations of the City of Columbus; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of the Department of Public Utilities be, and hereby is, authorized to execute those documents prepared by the Department of Law, Real Estate Division, necessary to release a certain sanitary sewer easement in and to the following described real property, acquired by virtue of a deed of easement recorded in Official Records, Recorded Instrument Number 199904300109186 in the Recorder's Office, Franklin County, Ohio, to wit:
Situated in the State of Ohio, County of Franklin and City of Columbus, being a fifteen feet wide sanitary sewer easement across that 17.685 acre tract of land conveyed to BELPER COMPANY by Official Record 11349 D-19, Recorder's Office, Franklin County, Ohio and being more particularly described as follows:
Beginning for reference at the west right of way of La Vista Drive (60'), being in the north boundary of said BELPER COMPANY tract of land at the terminus of La Vista Drive, thence along said west right of way
N 3º 45' 25" E, a distance of 23.64 feet to a point, thence
S 89º 48'14" W, a distance of 155.97 feet to a point, thence
N 10º46'07" W, a distance of 58.31 feet to a point,
Being the easterly line of an existing sanitary easement as described in Official Record 24088 J-08, thence along said easterly line of said easement,
S 10º46'07E, a distance of 279.34 feet to the true point of beginning of this sanitary sewer easement, thence
S 52º52'40" E, a distance of 176.38 feet to a point, thence
N 66º04'29" E, a distance of 539.77 feet to a point, thence
S 23º53'31" E, a distance of 15.00 feet to a point, thence
S 66º 06'29 W, a distance of 548.61feet to a point, thence
N 52º52' 40" W, a distance of 173.68 feet to a point in the east line of said existing sanitary sewer easement, thence along said east line,

N 10º 46' 07" W, a distance of 3.73 feet to the true point of beginning of this sanitary sewer easement.
The basis of bearings are those employed in the original deed of said BELPER COMPANY tract of land as found in Official Record 11349 D-19, Recorder's Office, Franklin County, Ohio.
Section 2. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
