Explanation

 

BACKGROUND:   This legislation authorizes an amendment to Ordinance No. 3549-2023, passed by Columbus City Council on December 11, 2023, to allow for a correction in the agreement type.

 

Ordinance No. 3549-2023 authorized the Director of Development to enter into a Subrecipient Agreement Not-for-Profit Service Contract with Community Shelter Board (CSB) in an amount up to $1,200,000.00 of which $600,000.00 utilized federal American Rescue Plan Act (ARPA) dollars and the remaining $600,000.00 from the Neighborhood Initiatives Subfund of the General Fund to support winter warming services that will help keep unhoused individuals safe during dangerous weather.  It was recently discovered that the agreement type should have been a Beneficiary Agreement.

 

Emergency action is requested to allow for the agreement type to be corrected to assure that the funding is in place under the proper agreement type so the appropriate reporting requirements are followed per federal guidelines.

 

 

CONTRACT COMPLIANCE:  The vendor number is 004795 and expires on 01/09/25.

Body

 

WHEREAS, Ordinance No. 3549-2023, passed by Columbus City Council on December 11, 2023, authorized the Director of  Development to execute a Subrecipient Agreement Not-for-Profit Service Contract with the Community Shelter Board to provide funding for warming shelters; and

 

WHEREAS, It was recently discovered that the type of agreement was incorrect and should have been a Beneficiary Agreement; and

 

WHEREAS, the Director of Development requests that Ordinance No. 3549-2023 be amended in order to correct the agreement type; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to amend Ordinance 3549-2023, passed by Columbus City Council on December 11, 2023 to assure that the funding is in place under the proper agreement type so that the appropriate reporting requirements are followed, all for the immediate preservation of the public health, peace, property, safety and welfare; and NOW THEREFORE,

 

                     

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That Section 1. of 3549-2023 be amended to read:  That the Director of the Department of Development is hereby authorized to enter into a Beneficiary Agreement with the Community Shelter Board in an amount up to $1,200,000.00 to support warming center programs for the unhoused population during the winter months, including food provided to clients, and to approve non-food and non-beverage purchases incurred prior to the establishment of the purchase order. 

 

SECTION 2.  That Section 1. of 3549-2023 is hereby repealed.

 

SECTION 3.  For the reasons stated in the Preamble hereto, which is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
