Explanation
 
This ordinance authorizes the Public Service Director to enter into a contract with Jones-Stuckey Limited for general engineering services for the Sidewalk Installation Program Phase VI project in the amount of $200,000.00 for the Transportation Division.  These services include producing construction drawings for various projects within the public right-of way, especially those pertaining to sidewalks.  A contract for professional engineering services is needed to assure timely completion of the design plans.
 
The selection process for the professional services contract has been completed in accordance with provisions of Chapter 329.14 of the Columbus City Code, 1959.  Eleven firms submitted proposals.  The evaluation committee determined that Jones-Stuckey Limited, contract compliance #31-0723296 (expiring May 30, 2005) submitted the best overall proposal for this work.
 
Through previously passed and pending legislation, the Transportation Division has exhausted all available cash within the 1995, 1999 Voted Streets and Highways Fund.  This ordinance appropriates and transfers funding within the Special Income Tax Fund and then transfers it to the 1995, 1999 Voted Streets and Highways Fund to fund this contract.  This is a temporary measure until the next bond/note sale, at which time the money will be reimbursed to the Special Income Tax Fund.
 
Emergency action is requested to allow sidewalk design to proceed immediately; design is a prerequisite to sidewalk construction that will promote and enhance pedestrian safety, especially for school children now forced to walk in the street or on undivided berms.

To appropriate and authorize the City Auditor to transfer $200,000.00 from the Special Income Tax Fund to the 1995, 1999 Voted Streets and Highways Fund; to authorize the Public Service Director to enter into a contract with Jones-Stuckey Limited for professional engineering services associated with the Sidewalk Installation Program Phase VI project for the Transportation Division; to authorize the expenditure of $200,000.00 or so much thereof as may be needed from the 1995, 1999 Voted Streets and Highways Fund and to declare an emergency.  ($200,000.00)
 
Body
 
WHEREAS, there is a need to provide professional engineering design services in support of the Sidewalk Installation Program Phase VI project; and
 
WHEREAS, the Transportation Division received and evaluated proposals in accordance with the provisions for evaluating and awarding a professional services contract; and
 
WHEREAS, the Transportation Division recommends acceptance of the proposal submitted by Jones-Stuckey Limited; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the design services contract should commence immediately to expedite sidewalk construction that will promote and enhance pedestrian safety, especially for school children now forced to walk in the street or on undivided berms, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.   That from the unappropriated monies in the Special Income Tax Fund, Fund 430, and from the monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2004, the sum of $200,000.00 be and hereby is appropriated to the City Auditor, Department No. 22-01, Object Level One Code 10, Object Level Three Code 5500 and OCA Code 920023.
 
SECTION 2.  That the City Auditor is hereby authorized to transfer said funds to the 1995, 1999 Voted Streets and Highways Fund, Fund 704, at such time as it is deemed necessary by the City Auditor and to expend said funds or so much thereof as may be necessary.
 
SECTION 3.  That $200,000.00 be and hereby is appropriated within the 1995, 1999 Voted Streets and Highways Fund, Fund 704, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6682, OCA Code 644385, Project 530790 for this purpose for the Transportation Division.
 
SECTION 4.  That upon obtaining other funds for this capital improvement, the City Auditor is hereby authorized to repay the Special Income Tax Fund the amount transferred under Section 2 above, and said funds are hereby deemed appropriated for such purpose.
 
SECTION 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract(s) or contract modification(s) associated with the expenditure of the funds transferred under Section 2 above.
 
SECTION 6.  That the City intends that this ordinance constitute an official intent for purposes of Section 1.150-2(e) of the Treasury Regulations promulgated pursuant to the Internal Revenue Code of 1986, as amended.
 
SECTION 7.  That the Public Service Director be and hereby is authorized to enter into a contract with Jones-Stuckey Limited, 2323 West Fifth Avenue, Suite 160, Columbus, Ohio 43204 in the amount not to exceed $200,000.00 for professional engineering services associated with the Sidewalk Installation Program Phase VI project for the Transportation Division.
 
SECTION 8.  That the expenditure of $200,000.00, or so much thereof as may be necessary be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Transportation Division, Department No. 59-09, Object Level One Code 06, Object Level Three Code 6682, OCA Code 644385 and Project 530790.
 
SECTION 9.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the mayor neither approves nor vetoes the same.
