Explanation
This legislation authorizes the Director of Public Utilities to modify the professional engineering services agreement with Burgess and Niple, Limited for purposes of providing engineering Services During Construction in connection with the construction of the Jackson Pike Wastewater Treatment Plant New Headworks Project 650252. The Division of Sewerage and Drainage has determined that these services cannot be performed by city personnel at this time, and has planned for the procurement of these services on a routine basis. The contract total including this modification is $7,711,661.00. The cost of these services is consistent with those provided for under the existing agreement. This legislation also provides for amending the 2003 Capital Improvements Program.
This agreement is being funded incrementally by modification as the work progresses through the three planned project steps Step 1 - Preliminary Design, Step 2 - Detailed Design, and Step 3 - Services During Construction. This modification provides funding for additional Step 3 - Services During Construction tasks. During the construction of Contract J205, Preliminary Treatment and Reliability Improvements, additional needs were identified, that require additional funding for purposes of providing plant monitoring and control of the Flow Control Structure at Rhodes Park; to incorporate processes into the plant wide control system; to provide on-line training for the new equipment; and modifications to accommodate plant maintenance and operational needs. The modification total is $343,075.00.

WHEREAS, Contract No. EL900635, with Burgess and Niple, Limited was authorized by Ordinance No. 1138-99, passed on May 10, 1999 for purposes of providing engineering services in connection with the Jackson Pike Wastewater Treatment Plant New Headworks for the Division of Sewerage and Drainage, Department of Public Utilities; and
Whereas, The Division of Sewerage and Drainage has determined it necessary to modify the subject agreement in order to provide additional Step 3 Services During Construction that are required to successfully administer the Jackson Pike Wastewater Treatment Plant New Headworks;
Whereas, it is immediately necessary to amend the 2003 Capital Improvements to provide sufficient authority for increasing a capital project account; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That from the unappropriated monies in the Sewerage System Reserve Fund 654, and from all monies estimated to come into said fund from any and all sources, and unappropriated for any other purpose during the fiscal year ending December 31, 2003, the sum of $343,075.00 is hereby appropriated to the Division of Sewerage and Drainage, Division 60-05, Object Level One 10, Object Level Three 5502, OCA Code 901553.
Section 2. That the City Auditor is hereby authorized and directed to transfer $343,075.00 to the Ohio Water Pollution Control Loan Fund No. 666, into the appropriate project accounts as specified within Section 3 herein, at such time as deemed necessary by him, and to expend said funds, or so much thereof as may be necessary.
Section 3. That the expenditure of $343,075.00 is hereby appropriated for the following sanitary sewer system projects within Ohio Water Pollution Control Loan Fund No. 666| Division 60-05| Object Level Three No. 6678| as follows:

Section 4. That upon obtaining other funds for the purpose of funding sanitary sewer system capital improvement work, the City Auditor is hereby authorized to repay the Sewerage System Reserve Fund the amount transferred under Section 2., above, and said funds are hereby deemed appropriated for such purpose.
Section 5. That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract or contract modifications associated with the expenditure of the funds transferred under Section 2., above.
Section 6. That the director of Public Utilities be, and hereby is authorized to modify Contract No. EL900635, with Burgess and Niple, Limited, 5085 Reed Road Columbus, Ohio 43220 for purposes of providing additional services during construction in connection with the JPWWTP New Headworks Project, Plant, in accordance with the terms and conditions as shown in the agreement modification agreement on file in the General Engineering Section of the Division of Sewerage and Drainage.
Section 7. That the expenditure of $343,075.00,or as much thereof as may be needed, be and the same hereby is authorized from the Ohio Water Pollution Control Loan Fund No. 666; Division 60-05; within the following project:

Section 8. That the 2003 Capital Improvements Budget Ordinance No. 1943-03 is hereby amended as follows, in order to provide sufficient budget authority for the execution of a professional engineering service contract modification award as referenced in the preamble hereto:
