Title: To authorize and direct the Finance and Management Director to modify FL003390 and past, present and future contracts and purchase orders with Ohio Water and Waste Supply to reflect a name change, and to declare an emergency.
Explanation
 
BACKGROUND:  To change the company name and Federal Identification number for contracts and purchase orders established with Ohio Water & Waste Supply to HD Supply Waterworks, Ltd., due to an acquisition, and to modify FL003390 for Mainline Parts and Fire Hydrants, Division of Water, to reflect this change.  This ordinance authorizes the assignment of all past, present and future business done by the City of Columbus from Ohio Water & Waste Supply FID 31-1253267 to HD Supply Waterworks, Ltd. FID 03-0550887, contract compliance expires 1/17/09.
 
This company is not debarred according to the Excluded Parties listing of the Federal Government and is not listed in the Auditor of State database for Findings for Recovery.
 
1. Amount of additional funds:  No additional funds are necessary to modify the option contract.
2. Reason additional needs were not foreseen: The current supplier has been acquired.
3. Reason other procurement processes not used: The same exact product is required as originally bid. No lower pricing/more attractive terms and conditions are anticipated through rebidding at this time.
4. How cost was determined:  Terms and conditions are in accordance with the original agreement.
 
FISCAL IMPACT: No additional monies are required to modify the option contract.  Each agency must set aside their own funding for their estimated expenditures.
 
In order to maintain an uninterrupted supply of parts to City agencies using this Universal Term Contract and open Purchase Orders, this ordinance is being submitted as an emergency.
 
 
Title
 
To authorize and direct the Finance and Management Director to modify FL003390 and past, present and future contracts and purchase orders with Ohio Water and Waste Supply to reflect a name change, and to declare an emergency.
 
Body
 
WHEREAS, the Finance/Purchasing Office established contract FL003390 for Mainline Parts and Fire Hydrants with Ohio Water & Waste Supply; and there are in existence purchase orders with Ohio Water & Waste Supply  for the option to purchase primarily water repair parts; and
 
WHEREAS, Ohio Water & Waste Supply  has been acquired by HD Supply Waterworks, Ltd. and in addition to notifying the City of acquisition,  HD Supply Waterworks, Ltd. has agreed to honor the past, present and future purchase orders established, and
 
WHEREAS, an emergency exists in the usual daily operation of the Finance/Purchasing Office in that it is immediately necessary to modify all contracts and purchase orders established with Ohio Water & Waste Supply, thereby preserving the public health, peace, property, safety, and welfare, now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Finance and Management Director be and is hereby authorized and directed to modify all past, present and future contracts and purchase orders to reflect the change of the company name and FID number from Ohio Water & Waste Supply FID 31-1253267 to HD Supply Waterworks, Ltd. FID 03-0550887.
 
SECTION 2.  That this modification is in accordance with Section 329.16 of the Columbus City Codes.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
