REZONING APPLICATION:  Z05-080.
 
APPLICANT:  Ronald Younkin, Trustee;  c/o Dave Perry, agent; The David Perry Company; 145 East Rich Street; Columbus, Ohio 43215.
      
PROPOSED USE:  Multi-family residential development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (5-1) on December 8, 2005.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The requested AR-12, Apartment Residential District mirrors the zoning of adjacent properties to the north and northeast.  These properties are developed with apartments and a single-family residence in the AR-12, Apartment Residential District.  To the east is a manufactured home development in the MHP, Manufactured Home Park District.  To the south is a single-family residence with agricultural uses in Hamilton Township.  To the west is an office and a single-family residence in Hamilton Township and undeveloped property, zoned AR-12, Apartment Residential District.  The applicant's request for the AR-12, Apartment Residential District is consistent with the surrounding zoning and development patterns in the area.

WHEREAS, application #Z05-080 is on file with the Building Services Division of the Department of Development requesting rezoning of 8.6± acres from MHP, Manufactured Home Park District, to AR-12, Apartment Residential District; and
 
WHEREAS, the developer has entered into a letter of commitment to be enforced by the Transportation Division regarding the extension of Southpoint Boulevard.; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the applicant's request for the AR-12, Apartment Residential District is consistent with the surrounding zoning and development patterns in the area.  The requested AR-12, Apartment Residential District mirrors the zoning of adjacent properties to the north and northeast.  These properties are developed with apartments and a single-family residence in the AR-12, Apartment Residential District.  To the east is a manufactured home development in the MHP, Manufactured Home Park District.  To the south is a single-family residence with agricultural uses in Hamilton Township.  To the west is an office and a single-family residence in Hamilton Township and undeveloped property, zoned AR-12, Apartment Residential District, now therefore:
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

DESCRIPTION OF AN 8.576 ACRE TRACT
SOUTH & WEST OF SOUTHPOINT BOULEVARD
COLUMBUS, OHIO
 
Situated in the State of Ohio, County of Franklin, Township of Hamilton, in Section 16, Township 4 North, Range 22 West, Mathews' Survey of Congress Lands, and being an 8.576 acre tract of land out of an original 59.700 tract of land conveyed to Shenandoah Partnership by deed of record in Official Record 14769, Page G 06, all records referenced to the Recorder's Office, Franklin County, Ohio, and bounded and described as follows:
Beginning at a 3/4" I.D. iron pipe found in a north line of said original 59.700 acre tract, at the southeast corner of the terminus of Southpoint Boulevard and the southwest corner of Lot No. 1, as both are shown of record upon the plat of Indian Meadows of record in Plat Book 59, Page 75;
thence S 03° 48' 27" W crossing a portion of said original 59.700 acre tract a distance of 172.00 feet to a 3/4" I.D iron pipe set at a point of curvature;
thence southerly crossing a portion of said original 59.700 acre tract and with a curve to the left, data of which is: radius = 970.00 and delta = 07° 41' 39", arc length of 130.26 feet and a chord distance of 130.16 feet bearing S 00° 02' 23" E to a 3/4" I.D. iron pipe set at a point of reverse curvature;
thence southerly crossing a portion of said original 59.700 acre tract and with a curve to the right, data of which is: radius = 1,016.50 and delta = 08° 17' 30", arc length of 147.10 feet and a chord distance of 146.98 feet bearing S 00° 15' 32" W to a 3/4" I.D. iron pipe set at the point of tangency;
thence S 04° 17' 47" W crossing a portion of said original 59.700 acre tract a distance of 168.50 feet to a 3/4" I.D iron pipe set in a south line of said original 59.700 acre tract and in the north line of 42.746 acre tract of land conveyed to T. Ronald and Barbara A. Sams, Trustees by deeds of record in Instrument 200201080007892 and Instrument 200201080007895;
thence N 85° 42' 13" W along a portion of a south line of original 59.700 acre tract and along a portion of the north line of said 42.746 acre tract a distance of 611.69 feet to a 3/4" I.D. iron pipe set a southwest corner of said original 59.700 acre tract and at the southeast corner of an original 1.692 acre tract of land conveyed to Ronald T. and Barbara A. Sams by deed of record in Official Record 7151, Page H 04;
thence N 04° 46' 35" E along a west line  of said original 59.700 acre tract and along the east line of said original 1.692 acre tract a distance of 258.05 feet to a 10-inch diameter maple tree found at a corner of said original 59.700 acre tract and at the northeast corner of said original 1.692 acre tract;
thence N 85° 49' 22" W along a south line of said original 59.700 acre tract and along a portion of the north line of said original 1.692 acre tract a distance of 12.73 feet to a 3/4" I.D. iron pipe set at a southwesterly corner of said original 59.700 acre tract and at the southeast corner of a 2.775 acre tract of land conveyed to George J. thence N 03° 48' 27" E along a west line of said original 59.700 acre tract and along the east line of said 2.775 acre tract a distance of 353.74 feet to a 3/4" I.D. iron pipe set at the northwest corner of said original 59.700 acre tract, at the northeast corner of said original 2.775 acre tract and in the south line of a 2.292 acre tract of land conveyed to George J. Kontogiannis by deed of record in Official Record 3003, Page F 08;
thence S 86° 11' 33" E along a portion of a north line of said original 59.700 acre tract, along a portion of the south line of said 2.292 acre tract, along the south line of a 1.878 acre tract of land conveyed to Network Residential Apartments II by deed of record in Instrument 199807290189592 and along the south end of Southpoint Boulevard a distance of 603.65 feet to the place of beginning;
containing 8.576 acre of land more or less, and being subject to all easements and restrictions of record.

Bull, Inc., Consulting Engineers & Surveyors, Columbus, Ohio, from an actual field survey performed under his supervision in September, 2005.  Basis of bearings is a south line of said original 59.700 acre tract, being N 85° 42' 13" W, as shown of record in Official Record 14769, Page G 06, Recorder's Office, Franklin County, Ohio.

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
