BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into a construction contract with Decker Construction Company, in the amount of $1,136,997.50, for the Utility Cut Restorations - 2012 Project, Contract Number 2011.
Various types of utility excavations are performed within the City of Columbus' right-of-way by the Department of Public Utilities.  The restoration work typically involves repair of existing pavement, curbs, and sidewalks in a manner conforming to the City of Columbus, 2012 Construction and Material Specifications (CMSC).  The Department routinely outsources this restoration work to a contractor that is equipped and trained to make these repairs.  Typical types of restoration work that requires outsourcing involve the installation of wheelchair ramps, asphalt repair involving thermalbond heatweld repairs, asphalt milling machines capable of full width milling, and the delivery of flowable controlled density fill using volumetric mixer trucks.
 
ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT:  This project will allow us to continue making timely repairs to roadway surfaces and sidewalks following repairs to the distribution system pipelines.
CONSTRUCTION CONTRACT AWARD:  The Director of Public Utilities publicly opened one bid on March 21, 2012 from Decker Construction Company, in the amount of $1,136,997.50.
Decker Construction Company's bid was deemed the lowest, most responsive and responsible bid in the amount of $1,136,997.50.  Their Contract Compliance Number is 31-0983557 (expires 2/3/14, Majority).  Additional information regarding this bidder, description of work, contract time frame and detailed amount can be found on the attached Information form.  The contract contains a multi-year renewal option.
Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Decker Construction Company.
FISCAL IMPACT:  $1,136,997.50 is budgeted and needed for this purchase.
The following amounts were encumbered in 2011 and 2010 for similar services:
2011:  $1,000,000 Water; $10,000 Electricity
2010:  $1,000,000 Water; $500,000 Sewerage; $50,000 Electricity

WHEREAS, one bid for the Utility Cut Restorations - 2012 Project was received and publicly opened in the offices of the Director of Public Utilities on March 21, 2012; and
WHEREAS, the sole bid from Decker Construction Company, in the amount of $1,136,997.50, was deemed the lowest, most responsive, and responsible bid; and
WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to award and execute a construction contract for the Utility Cut Restorations - 2012 Project with Decker Construction Company; and
 
WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities, to authorize the Director of Public Utilities to enter into a construction contract with Decker Construction Company, for the Utility Cut Restorations - 2012 Project, for the preservation of the public health, peace, property and safety; now therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Director of Public Utilities be and hereby is authorized to award and execute a construction contract for the Utility Cut Restorations - 2012 Project with the lowest, most responsive, and responsible bidder, Decker Construction Company, 3040 McKinley Avenue, Columbus, Ohio 43204; in the amount of $1,136,997.50; in accordance with the terms and conditions of the contract on file in the Department of Public Utilities.
SECTION 2.  That the expenditure of $1,136,997.50 or so much thereof as may be needed, is hereby authorized from Object Level One 03, Object level Three 3375, Fund Names and Numbers, Departments, OCA Codes and amounts listed below, to pay the cost thereof.

SECTION 3.  That this Ordinance shall take effect and be in effect and be in force from and after the earliest period allowed by law.
