Explanation
BACKGROUND: To change the company name and Federal Identification number for contract number FL002656 for the purchase of Ready Mix Concrete, FCDF & Related Materials for various city departments. This ordinance authorizes the assignment of all past, present and future business done by the City of Columbus with F.W. Sloter Inc., FID 314405874 to Harmon Concrete Corp., FID 204417159.
1. Amount of additional funds: No additional funds are necessary to modify the option contract.
2. Reason additional needs were not foreseen: The current supplier merged with another company.
3. Reason other procurement processes not used: The same exact product is required as originally bid. No lower pricing/more attractive terms and conditions are anticipated through rebidding at this time.
4. How cost was determined: Terms and conditions are in accordance with the original agreement.
FISCAL IMPACT: No funds are required to modify the option contract. Each agency must set aside their own funding for their estimated expenditures.
In order to maintain an uninterrupted of services to City agencies using this Universal Term Contract, this ordinance is being submitted as an emergency.
Title
To authorize and direct the Finance and Management Director to modify past, present and future purchase orders with Harmon Concrete Corp. to reflect a name change to the company as a result of new ownership; and to declare an emergency.
Body
WHEREAS, the Finance and Management Department/Purchasing Office established the contract with F. W. Sloter, Inc. for the option to purchase Ready Mix Concrete, FCDF & Related Materials; and
WHEREAS, Harmon Concrete Corp. purchased F.W. Sloter, Inc., in addition to notifying the City of the purchase, Harmon Concrete Corp. has agreed to honor the past, present and future purchase orders established from contract number FL002656, and
WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department/Purchasing Office in that it is immediately necessary to modify contract number FL002656, thereby preserving the public health, peace, property, safety, and welfare, now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director be and is hereby authorized and directed to modify contract FL002656 and all past, present and future purchase orders pursuant to that contract to reflect the change of the company name and FID number from F.W. Sloter, Corp., #314405874 to Harmon Concrete, Inc., #204417159.
SECTION 2. That this modification is in accordance with Section 329.16 of the Columbus City Codes.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
