Explanation
The City of Columbus, Public Service Department, Transportation Division, is engaged in the Alum Creek Drive Improvement Project. This project consists of the widening and reconstruction of approximately 2.07 miles of Alum Creek Drive from Williams Road northward to Performance Way/Refugee Road South. Total project costs, including design engineering, land acquisition, utility relocation and construction, are estimated to be $15 million. Construction is anticipated to begin in mid 2011 and be completed by the end of 2013. The project will include the addition of curb and gutter, sidewalks, a closed drainage system and street lighting as well as 2,275 feet of widening and reconstruction on Williams Road and 850 feet of widening and reconstruction on Watkins Road. Successful completion of this project requires that the City acquire fee simple title and lesser interests in and to various properties located along the project corridor and that the City participate in the relocation of existing utilities along these roadways. It is now necessary to authorize the City Attorney's Real Estate Division to contract for professional services, to negotiate with property owners and to expend those funds necessary to acquire additional rights-of-way, including fee simple title and lesser interests needed to complete this project.
Fiscal Impact: This is a Federal/State/City participation project with 80% of the total right-of-way acquisition costs being paid for with Federal/State funds and 20% of the total costs being paid from City funds. Preliminary right-of-way acquisition costs have been estimated by the project design consultant to be a total of $1,200,000.00. Monies to pay 100% of these costs are budgeted and available within the 2006 CIB in the 1995, 1999, 2004 Voted Streets and Highways Fund. These funds will be transferred to fund 765, the Federal State Highway Engineering Fund. As these funds are expended by the City Attorney's Real Estate Division the Transportation Division will seek reimbursement out of Federal/State funds for 80% of the total dollars spent.
Emergency Justification: Emergency action is requested to allow the City Attorney's Real Estate Division to immediately begin acquisition of the additional rights-of-way needed for this project so that utility relocation and construction of this improvement can proceed as currently scheduled.

To authorize the City Auditor to transfer $1,200,000.00 within and from the 1995, 1999, 2004 Voted Streets and Highways Fund to the Federal State Highway Engineering Fund; to appropriate $1,200,000.00 within the Federal State Highway Engineering Fund; To authorize the expenditure of $1,200,000.00 or so much thereof as may be needed from the Federal State Highway Engineering Fund for acquisition related expenses; to authorize the City Attorney's Real Estate Division to contract for professional services relative to the acquisition of fee simple title and lesser interests in and to property needed for the Alum Creek Drive Improvement project; to authorize the City Attorney's Real Estate Division to negotiate with the property owners for acquisition of the additional rights-of-way necessary to complete this project and to declare an emergency. WHEREAS, successful completion of this project requires that the City acquire fee simple title and lesser interests in and to various properties located along the project corridor; and
WHEREAS, preliminary right-of-way acquisition costs have been estimated by the project design consultant to be approximately $1,200,000.00; and
WHEREAS, this is a Federal/State/City participation with 80% of the total right-of-way acquisition costs being paid for out of Federal/State funds; and
WHEREAS, $1,200,000.00 is budgeted and available in the 1995, 1999, 2004 Voted Streets and Highways Fund to pay for these right-of-way acquisition costs; and
WHEREAS, as these funds are expended by the City Attorney's Real Estate Division the Transportation Division will seek immediate reimbursement out of Federal/State funds for 80% of the total dollars spent; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to authorize City Attorney's Real Estate Division to contract for professional services, to negotiate with property owners to acquire the additional rights-of-way needed to complete this project as currently scheduled thereby preserving the public health, peace, property, safety and welfare; now, therefore; and
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the transfer of $1,200,000.00 within Fund 704, the 1995, 1999, 2004 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, be and hereby is authorized as follows:

SECTION 3. That the sum of $1,200,000.00 be and hereby is appropriated from the unappropriated balance of Fund 765, the Federal State Highway Engineering Fund, and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2007, to Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6601.
SECTION 4. That the monies appropriated in the foregoing Section 3 shall be paid upon order of the Public Service Director and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
SECTION 5. That the City Attorney's Real Estate Division be and is hereby authorized to hire professional services, including but not limited to title, appraisal and right-of-way negotiation services relative to the acquisition of fee simple title and lesser interests in and to real estate needed for the Alum Creek Drive Improvement project.
SECTION 6. That the City Attorney's Office, Real Estate Division, be and is hereby authorized to expend $1,200,000.00, or so much thereof as may be necessary from fund 765, the Federal State Highway Engineering Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6601 (OCA and Grant #s to be established by Auditor's Office at a later date), to pay those costs relative to the acquisition of the additional rights-of-way required for the Alum Creek Drive Improvement project.
SECTION 7. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
