Explanation
 
Background:     The City of Columbus Franklinton Pride Center provides residents with improved access to City services, better interagency communication, and the ability for residents to participate in identifying and addressing the specific needs of their own neighborhoods.  The Franklinton Pride Center has occupied leased office space at 1186 W. Broad Street Avenue since August 2005. The current lease agreement expires March 31, 2009. The City ("Lessee") desires to enter into a new lease agreement with Tom and Agnes Zanetos ("Lessor"), for the continued rental of approximately 1,614 square feet of office space for this community pride center.
 
The following legislation authorizes the Director of the Department of Finance and Management, on behalf of the Department of Development, to execute those documents necessary to enter into a one (1) year lease agreement between the aforementioned parties, with the option of four (4) successive automatic renewal terms of one year each. The rent for the initial lease term will be at $10,287.00 which is the same annual rent as the expiring  lease. The first renewal will contain no increase in annual rent. Beginning with the second renewal term, the rent will increase to $10,595.64 annually for each of the three remaining renewals.
 
A rent survey was conducted for comparable space in the area, and the stated rent rate is reasonable for the area.

Fiscal Impact:  This legislation authorizes the expenditure of $10,287 from the Special Income Tax Fund, appropriated through Ordinance 0087-2009, passed 2/10/2009.
 
Emergency Justification: Emergency action is requested to allow for the immediate execution of the subject lease agreement by the City in order to allow the commencement date of this Lease Agreement to coincide with the current expiration date without delay.
 
 
Title
 
To authorize the Director of the Department of Finance and Management to execute those documents necessary to enter into a one (1) year lease agreement by and between the City of Columbus and Tom and Agnes Zanetos for approximately 1,614 square feet of office space located at 1186 W. Broad Street for the Franklinton Pride Center; to authorize the expenditure of $10,287.00 from the Special Income Tax Fund; and to declare an emergency. ($10,287.00)
 
 
Body
 
WHEREAS,  the City of Columbus operates the Franklinton Pride Center  for the purpose of providing residents with improved access to City services, better interagency communication, as well as the ability for residents to participate in identifying and addressing the specific needs of their own neighborhoods; and
 
WHEREAS,  the City ("Lessee") and Tom and Agnes Zanetos ("Lessor") desire to enter into a lease agreement for the rental of that real property, which includes approximately 1,614 square feet of office space, located at 1186 W. Broad Street, Columbus, Ohio 43222; and
 
WHEREAS, the City appropriated rental funds pursuant to Ordinance #0087-2009; and
 
WHEREAS, it is necessary to authorize the expenditure of rental funds; and
 
WHEREAS, an emergency exists in the usual daily operation of the City of Columbus, in that it is immediately necessary to authorize the Director of the Department of Finance and Management to execute those documents necessary to enter into a one (1) year lease agreement in order to allow the commencement date of this Lease Agreement to coincide with the current expiration date without delay, and for the immediate preservation of the public health, peace, property and safety; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
SECTION 1.   That the Director of the Department of Finance and Management be, and hereby is, authorized to execute those documents approved by the Department of Law, Division of Real Estate, necessary to enter into a one (1) year lease agreement by and between the City of Columbus, ("Lessee"), and Tom and Agnes Zanetos, ("Lessor"), for the rental of certain real property which includes approximately 1,614 square feet of office space, located at 1186 W. Broad Street, Columbus, Ohio 43207.
 
SECTION 2.  That the terms and conditions of the lease shall be in form approved by the City Attorneys Office and shall include the following:
 
a)  The Lease shall have an initial term of one (1) year commencing on April 1, 2009 and terminating on March 31, 2010.  Subject to appropriation of necessary rental funds by Columbus City Council and certification of availabilty of rental funds by the City Auditor, the lease agreement shall, subject to appropriation of funds by Columbus City Council and certification of availabilty of rental funds by the City Auditor for each renewal term, automatically renew for four (4) one year terms, unless Lessee provides 60 days written notice to Lessor of Lessee's intent allow the lease agreement to terminate at the end of the then current term.
 
b)  Subject to appropriation of funds by Columbus City Council and certification of availability of rental funds by the City Auditor, the Lessee agrees to pay Lessor a total annual rent of $10,287.00 for the initial term of the lease.  Subject to appropriation of funds by Columbus City Council and certification of availability of rental funds by the City Auditor for each renewal term, the rental rate for the first successive renewal period shall remain the same, and that the rental rate shall increase to $10,595.64 per year for each of the remaining three successive renewal terms.
 
c)  Such other terms and conditions as agreed to and approved by the City Attorney.
 
SECTION 3.  That the expenditure of $10,287.00, or so much thereof as may be necessary, is hereby authorized and approved as follows:

SECTION 4.  That the City Auditor is authorized to make any changes to revise the funding source for all contract or contract modifications associated with this ordinance.
 
SECTION 5.   That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure, and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
