Explanation
 
The Purchasing Office received and opened bid number SA00470GRW for two 130 HP four-stroke outboard motors on June 26, 2003.  This is a re-bid from the original solicitation, SA000445GRW, in which the only bid received did not meet specifications.  These motors are needed for the boats at the Watershed facility, of the Division of Water, for ranger patrol.  Three bids were received and the Purchasing Office deemed them all complete.  Delta Marine submitted the lowest bid, however, they bid a two-stroke engine instead of a four-stroke engine as specified.  Therefore, we are recommending award of this contract go to Buckeye Lake Marina, as the next lowest responsive, responsible, and best bidder to meet specifications, for a total of $21,810.32.  The Contract Compliance Number for Buckeye Lake Marina is 31-1303205.  They do not have MBE/FBE status.  Only one company of the 18 solicited had MBE/FBE status.  
 
It is requested that this Ordinance be handled in an emergency manner, as these motors had to re-bid since no vendors submitted bids meeting specifications.  The Watershed facility will still be able to use the motors in the fall, if we purchase as soon as possible.     
 
FISCAL IMPACT: The Division of Water allocated $22,000.00 for these motors in the 2003 Budget.  There were no expenditures for these boat motors in the last two years.

WHEREAS, the Purchasing Office did receive and open three bids for the purchase of two 130 HP four-stroke outboard motors on June 26, 2003, and
 
WHEREAS, the lowest bidder did not meet our specification of a four-stroke engine by bidding a two-stroke engine, therefore, we are asking that the contract be awarded to the next lowest responsive, responsible, and best bidder to meet specifications, and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Water, Department of Public Utilities, in that it is immediately necessary to authorize the Finance Director to enter into a contract for two 130 HP four-stroke outboard motors, needed by the Watershed activity, for the immediate preservation of public health, peace, property and safety; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Finance Director be and is hereby authorized to enter into a contract with Buckeye Lake Marina, Inc. as the lowest responsive, responsible, and best bidder to meet specifications, for two 130 HP four-stroke outboard motors, for the Division of Water, Department of Public Utilities.
 
Section 2.  That the expenditure of $21,810.32 or as much thereof as may be needed, is hereby authorized from Water Works Fund 600, Department 60-09, OCA Code 603001, Object Level One 06, Object Level Three 6651, to pay the cost thereof.
 
Section 3.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
