DEVELOPMENT COMMISSION RECOMMENDATION: Approval (5-0) on June 13, 2024.
CITY DEPARTMENTS' RECOMMENDATION: Approval. The site consists of an undeveloped parcel within the L-M, Limited Manufacturing District. The applicant requests this L-M district to allow limited less-objectionable uses and commercial uses which are prohibited in the existing L-M district. The new limitation text includes appropriate use restrictions and supplemental development standards addressing traffic access to the site and street trees that are consistent with Columbus Citywide Planning Policies (C2P2) Design Guidelines (2018). Additionally, the proposed uses are consistent with the existing zoning and development pattern along this portion of Dublin Road.

WHEREAS, application #Z24-019 is on file with the Department of Building and Zoning Services requesting rezoning of 1.17± acres from L-M, Limited Manufacturing District, to L-M, Limited Manufacturing District; and
WHEREAS, the Development Commission recommends approval of said zoning change; and
WHEREAS, the City Departments recommend approval of said zoning change because the requested L-M, Limited Manufacturing District will allow limited less-objectionable and commercial uses that are consistent with the existing development and zoning pattern along this portion of Dublin Road; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
2125 MARBLE CLIFF OFFICE PARK (43215), being 1.17± acres located on the southeast corner of Marble Cliff Office Park and Dublin Road, and being more particularly described as follows:
Situated in the State of Ohio, County of Franklin, City of Columbus, being in Sections 2 and 11, range 23, Congress Lands and being a 1.168 acre area of land, more or less, said 1.168 acre being out of that 2.308 acre tract of land described in Exhibit “A” in the deed to Marble Cliff Office Park One, LLC, of record in instrument No. 200304100014150, Recorder’ s Office, Franklin County, Ohio, said 1.168 acre area of land being more particularly described as follows:
Beginning for reference, at a p.k. nail found at the point of intersection of the easterly right-of-way line of Dublin Road (United States Route 33) and the southeasterly right-of-way of Cardigan Avenue; thence southwardly, with the easterly right-of-way line of said Dublin Road and with the arc of a curve to the left having a radius of 11399.16 feet, a central angle of 0 deg. 48 min. 00 sec. and a chord that bears S 21 deg. 03 min. 35 sec. E, a chord distance of 159.16 feet to a ¾-inch (I.D.) iron pipe found; thence 37 deg. 29 min. 25 sec. E, with the northeasterly right-of-way line of said Dublin Road and with the southwesterly line of that 1.751 acre tract of land described in Exhibit “A” in the deed to Marble Cliff Office Park Two, LLC, of record in Instrument No. 200304100114153, Recorder’s Office, Franklin County, Ohio, the same being parallel with and 30.00 feet northeasterly from, as measured at right angles, the old centerline of said Dublin Road, a distance of 196.41 feet to a ¾ -inch (I.D.) iron pipe found at the southwesterly corner of said 1.751 acre tract in the northerly line of said 2.308 acre tract; thence N 86 deg. 05 min. 21 sec. W, with the northerly line of said 2.308 acre tract, a distance of 39.99 feet to a ¾-inch (I.D.) iron pipe found in the old centerline of said Dublin Road at the northwesterly corner of said 2.308 acre tract; thence S 37 deg. 29. min. 25 sec. E, with the old centerline of said Dublin Road and with the southwesterly line of said 1.751 acre tract, a distance of 102.45 feet to a railroad spike found at the true point of beginning at an angle point in the old centerline of said Dublin Road in the existing corporation line between the Village of Marble Cliff and the City of Columbus, said point also being the southwesterly corner of said 1.751 acre tract and the northwesterly corner of said 2.308 acre tract;
Thence, from said true point of beginning, eastwardly, with said existing corporation line between the Village of Marble and the City of Columbus, with the northerly boundary of said 2.308 acre tract and with the southerly boundary of said 1.751 acre tract, the following (3) courses and distances:
1.) N 77 deg. 56 min. 01 sec. E, a distance of 279.19 feet to a 3/4-inch (I.D.) iron pipe set;

3.) N 74 deg. 21 min. 15 sec. E, a distance of 5.12 feet to a 3/4-inch (I.D.) iron pipe set;
Thence S 12 deg. 03 min. 59 sec. E, a distance of 166.51 feet to a 3/4-inch (I.D.) iron pipe set in the southerly line of said 2.308, the same being in the northerly line of that 2.359 acre tract of land described in Exhibit “A” in the deed to Kinsley Family Partnership, of record in Official Record 26960C07, Recorder’s Office, Franklin County, Ohio.
Thence S 84 deg. 22 min. 21 sec. W, with the southerly line of said 2.308 acre tract and with the northerly line of said 2.359 acre tract, a distance of 323.77 feet to a 3/4-inch (I.D.) iron pipe set in the old centerline of Dublin Road at the southwesterly corner of said 2.308 acre tract, the same being the northwesterly corner of said 2.359 acre tract;
Thence N 12 deg. 14 min. 17 sec. W, with the old centerline of Dublin Road and with the westerly line of said 2.308 acre tract, a distance of 140.72 feet to the true point of beginning and being a 1.168 acre tract of land, more or less.

We hereby state that the foregoing description was prepared from information obtained from actual field surveys conducted by Bauer, Davidson and Merchant, Inc. in June and September of 2001 and in August of 2003.
All of the survey markers noted in the foregoing description were in place of August of 2003.

1. INTRODUCTION: The subject property site ("Site") is located along Dublin Road, a major collector roadway and within a vibrant corridor of other limited manufacturing and commercial uses. The Site has been vacant since it was originally zoned LM, back in 2001. The Applicant seeks to expand the permitted business office, commercial and retail uses for the Site.
2. PERMITTED USES: The permitted uses shall include all uses allowed in Chapter 3363.01 (C-1, C-2, C-3, C-4 and C-5) of the Columbus City Code, retaining 3363.02 through 3363.08 excepting therefrom:
