Explanation
This legislation authorizes the Public Service Director to enter into a contract for the Transportation Division in the amount of $258,153.50 for the replacement of the Overbrook Drive Culvert (#2) and to pay construction inspection costs up to $30,276.74. The project limits are on Overbrook Drive #2 West of Indianola Avenue. (See attached map.) The notice to proceed is tentatively scheduled for August 15, 2004. This project has been given 120 days to construct from the date the notice to proceed is issued with a completion date of December 15, 2004. This project was advertised in the City Bulletin . The Transportation Division solicited six bidders (5 majority, 1 minority) and three bids were received, (2 majority, 1 minority)and tabulated on June 10, 2004 as follows:

The Transportation Division recommends a contract award to Complete General Construction Company, Contract Compliance #31-4366382 (expiring 4/5/05) as the lowest, best, most responsive and most responsible bidder.
Emergency action is requested so that construction may begin and be completed by the end of the 2004 construction season.
Fiscal Impact: The Transportation Division budgeted $250,000 in the 2004 Capital Improvements Budget the Overbrook #2 Culvert. This ordinance authorizes and expenditure of $288,430.24. The additional $38,430.24 will need to come from other projects within the Bridge Rehabilitation project.

Body
WHEREAS, the Transportation Division is responsible for maintaining the City's roadways; and
WHEREAS, bids were received and tabulated on June 10, 2004, for the Overbrook #2 Culvert Replacement project; and
WHEREAS, a satisfactory bid has been received; and
WHEREAS, the Transportation Division recommends acceptance of the lowest, best, most responsive and most responsible bid submitted by Complete General Construction Company, and
WHEREAS, it is necessary to provide for construction inspection; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contract should be awarded immediately so that the work may proceed without delay and be completed this construction season, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Public Service Director be and hereby is authorized to enter into a contract with Complete General Construction, 1221 East Fifth Avenue, Columbus, Ohio 43219, for the construction of the Overbrook Drive #2 Culvert Replacement project for the Transportation Division in accordance with the specifications and plans on file in the office of the Public Service Director, which are hereby approved; to obtain and pay for the necessary inspection costs.
SECTION 2. That for the purpose of paying the cost of the contract and inspection, the sum of $288,430.24, or so much thereof as may be needed, be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division as follows:

SECTION 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
