Background:
 
The following is a resolution to declare the necessity and intent to appropriate construction easements in, over, under and through real estate in connection with the Pedestrian Safety Improvements - Valleyview Sidewalks Project.
 
Fiscal Impact:
 
    N/A
 
Emergency Justification:  Emergency action is requested by the Department of Public Service to allow the acquisition of the parcels necessary for this project to proceed without delay.

To declare the necessity and intent to appropriate easements in, over, under and through real estate in connection with the Pedestrian Safety Improvements - Valleyview Sidewalks Project, and to declare an emergency.
 
 
Body
 
WHEREAS,      the City of Columbus is engaged in the Pedestrian Safety Improvements - Valleyview Sidewalks Project; and,
 
WHEREAS,      an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction, in that it is immediately necessary to declare the necessity and intent to appropriate easements in, over, under and through the hereinbefore described real estate necessary for the Pedestrian Safety Improvements - Valleyview Sidewalks Project so that there will be no delay in the project thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
 
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
      Section 1.      That this Council hereby declares the necessity and intent to appropriate easements in, over, under and through the following described real estate necessary for the Pedestrian Safety Improvements - Valleyview Sidewalks Project, Project #590105-100034, pursuant to and in accordance with the Charter of the City of Columbus, Columbus City Code (1959) Revised, Chapter 909, the Constitution of the State of Ohio and Ohio Revised Code, Chapter 719; to-wit:

2898-3015 Valleyview Drive, Columbus, Ohio  43204
      
Situated in the State of Ohio, County of Franklin, City of Columbus, Virginia Military Survey No. 1390, and being part of a 15.038 acre tract in the name of The Board of Education of the City School District of Columbus, Ohio, as  being described in Deed Volume 1977, Page 564, Recorder's Office, Franklin County, Ohio:
      Beginning for reference at a point in the centerline intersection of Westmoor Avenue (60' Right-of-Way) and Valleyview Drive (60' Right-of-Way);
      Thence, N 87º45'59" W, a distance of 168.00 feet along the centerline of said Valleyview Drive (60' Right-of-Way), also being the northerly line of said 15.038 acre tract, to the northwest corner of said 15.038 acre tract;
      Thence S 03º23'59" E, a distance of 30.15 feet along the westerly line of said 15.038 acre tract to the southerly right-of-way line of said road, and the True Place of Beginning for this particular tract herein being described;
      Thence through said 15.038 acre tract the following five (5) courses and distances:
 
1)      S 87º45'59" E, a distance of 198.67 feet;
2)      S 02º14'01" W, a distance of 5.00 feet;
3)      N 87º45'59" W, a distance of 155.00 feet;
4)      S 02º14'01" W, a distance of 5.00 feet;
5)      N 87º45'59" W, a distance of 42.69 feet to the westerly line of said 15.038 acre tract;
Thence N 03º23'59" W, a distance of 10.05 feet along said westerly line to the True Place of Beginning, containing 0.027 acres more or less, subject to all legal highways, easements, leases or restrictions of record and of records in the respective utility offices.
      Bearings are based on the Ohio State Plane Coordinate System, NAD83, CORS96, Ohio South Zone, Established by using the (VRS) Virtual Reference System of a (GPS) Global Positioning Survey.

Situated in the State of Ohio, County of Franklin, City of Columbus, Virginia Military Survey No. 875, and being part of a 1.860 acre tract in the name of ESS Prisa LLC, a Delaware Limited Liability Company, as being described in Instrument No. 200507270149134, Recorder's Office, Franklin County, Ohio:
      Beginning for reference at the centerline intersection of Wilson Road (Right-of-Way Varies) and Valleyview Drive (70'Right-of-Way);
      Thence, N 79º54'42" E, a distance of 557.98 feet along the centerline of said Valleyview Drive, passing the southwesterly corner of a 0.148 acre tract in the name of City of Columbus as described in Deed Volume 4584, Page D13, at 489.40 feet;
      Thence N 10º05'18" W, a distance of 30.00 feet through said 0.148 acre tract to the northerly line of said 0.148 acre tract, being N 79º54'42" E, a distance of 84.03 feet from the southwest corner of said 1.860 acre tract, and the True Place of Beginning for this particular tract herein being described;
      Thence through said 1.860 acre tract the following three (3) courses and distances:
 
1)      N 10º05'18" W, a distance of 6.00 feet;
2)      N 79º54'42" E, a distance of 40.00 feet;
3)      S 10º05'18" E, a distance of 6.00 feet to the northerly line of said 0.148 acre tract and being
      S 79º54'42" W, a distance of 91.22 feet from the southeast corner of said 1.860 acre tract;
      Thence S 79º54'42" W, a distance of 40.00 feet along the said northerly right-of-way line, also being the northerly line of said 0.148 acre tract, to the True Place of Beginning, containing 0.005 acres more or less, subject to all legal highways, easements, leases or restrictions of record and of records in the respective utility offices.

      Section 2.      That the City Attorney be and hereby is authorized to cause a written notice of the adoption of this resolution to be served upon the owners, persons in possession of or persons having a real or possible interest of record in the above described premises in the manner provided by law.
 
      Section 3.      That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this resolution is declared to be an emergency measure and shall take effect and be in force from and after its adoption and approval by the Mayor, or ten days after adoption if the Mayor neither approves nor vetoes the same.
