Explanation
1. BACKGROUND
This legislation authorizes the Director of Public Service to enter into contract in an amount up to $194,048.53 for the Pedestrian Safety Improvements - Obetz Road Sidewalk Project and to pay construction inspection costs up to $38,809.70.
This project will construct 1,980 linear feet 5 foot wide sidewalk on each side of Obetz Road between Beth Ann Drive and Parsons Avenue. 14 ADA ramps will also be built. There are 4 bus stops and transit routes within the limits of this project. Pedestrian generators and destinations impacting the proposed project include Indian Mound Recreation Center.
The estimated Notice to Proceed date is estimated to be October 10, 2011. The project was let by the Office of Support Services through vendor services. 6 bids were received on June 30, 2011 (6 majority, 0 minority) and tabulated on June 31, 2011 as follows:

3. FISCAL IMPACT
The amount of the contract and inspection for this project is $232,858.23. Funding for this project will consist of a New Freedom Grant and the Streets and Highways G.O. Bonds Fund.
4. EMERGENCY DESIGNATION
Emergency action is requested to facilitate the completion of the project this construction season and to make these sidewalks available to pedestrians as early as possible.

To authorize the Director of Public Service to enter into contract with Newcomer Concrete Services, Inc. for construction of the Pedestrian Safety Improvements - Obetz Road Sidewalks Project for the Division of Mobility Options; to authorize the transfer of monies within and from the Streets and Highways G.O. Bonds Fund to the Federal-State Highway Engineering Fund; to authorize the appropriation and expenditure of $232,858.23 within and from the Federal-State Highway Engineering Fund, for the Division of Mobility Options; and to declare an emergency. Body
WHEREAS, bids were received on June 30, 2011 and tabulated on June 31, 2011, for the Pedestrian Safety Improvements - Obetz Road Sidewalks Project and a satisfactory bid has been received; and
WHEREAS, it is necessary to provide for construction inspection costs; and
WHEREAS, the Department of Public Service applied for and received a New Freedom Grant for this project; and
WHEREAS, On September 17, 2008 Ordinance 1307-2008 was passed to enter into a grant agreement with COTA and accept New Freedom grant funds.
WHEREAS, on September 14, 2009 Ordinance 1031-2009 was passed to enter into a grant agreement with COTA and accept additional grant funds for the Pedestrian Safety Improvements - Obetz Road Sidewalks.
WHEREAS, these grants will be utilized to provide funding for this project; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Mobility Options, in that it is necessary to expedite the commencement of this project in order to construct the project this construction season and make these sidewalks available to the public to provide a safe walking area, thereby preserving the public health, peace, property, safety and welfare, now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Public Service be and is hereby authorized to enter into a contract with the Newcomer Concrete Services, Inc., 646 Townline Road 151, Norwalk, OH 44857, for the construction of the Pedestrian Safety Improvements - Obetz Road Sidewalks Project in the amount of $194,048.53, for the Division of Mobility Options in accordance with the specifications and plans on file in the Office of the Support Services, which are hereby approved; and to obtain and pay for the necessary inspection costs associated with this project up to a maximum of $38,809.70.
SECTION 2. That the 2011 Capital Improvement Budget be amended to provide sufficient authority for this project as follows:

SECTION 7. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 8. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
