Explanation

 

 Background: The purpose of this legislation is to amend Ordinance 2420-2025, which was passed by Columbus City Council on October 27, 2025 to allow for a correction of the name and vendor number. The purpose of ORD 2420-2025 was to authorize the Director of the Department of Public Utilities to enter into a contract with Suburban Propane L.P. for Offsite Biosolids Anaerobic Digestion through December 31, 2026. The reason Public Utilities is requesting this amendment is due to the fact that the original ORD 2420-2025 referenced the entity name Suburban Propane L.P. and vendor number 019071, instead the vendor has successfully registered under the name Suburban Sales & Services Inc and vendor number 053629.

FISCAL IMPACT:  Auditor’s Certificate # ACPR003227 from Ordinance 2420-2025 will be utilized to establish the Purchase Order after this Ordinance has passed.  No additional funds are requested at this time. 

EMERGENCY DESIGNATION:  Emergency action of this ordinance is requested so the Purchase Order can be established before the ACPR expires.

Body

 

WHEREAS, Ordinance 2420-2025 authorized the Director of Public Utilities to enter into a service contract with Suburban Propane L.P for Offsite Biosolids Anaerobic Digestion; and

WHEREAS, after passage of Ordinance 2420-2025 it was determined that the vendor number and name did not appear correctly in all parts of the ordinance to be used for this contract; and

WHEREAS, the Director of Public Utilities requests that Ordinance 2420-2025 be amended in order to correct the company name and vendor number in all parts of the ordinance so the Director of Public Utilities may proceed with entering into contract with Suburban Sales & Services Inc for this service; and

WHEREAS, Auditor’s Certificate # ACPR003227 from Ordinance 2420-2025 will be utilized to establish the new contract after this Ordinance has passed.  No additional funding is necessary or required with this ordinance; and

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, in that it is immediately necessary to authorize the amendment to Ordinance 2420-2025 so that the Purchase Order can be established before the ACPR expires; now, therefore

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

SECTION 1.  That Ordinance 2420-2025 be and hereby is amended as follows, with additions in underlined in bold and deletions in strikethrough:

The City of Columbus operates a composting facility that processes sewage sludge from two interconnected wastewater treatment plants into soil conditioner / mulch for wholesale. The City of Columbus Composting Facility has goals to reduce the amount of waste products going to landfills. In pursuit of these goals The City of Columbus Compost Facility has partnerships with other sustainable focused facilities in the area including the offsite anaerobic digester owned and operated by Suburban Propane, L.P. Suburban Sales & Services Inc.

To authorize the Director of the Department of Public Utilities to enter into a contract with Suburban Propane, L.P. Suburban Sales & Services Inc for Offsite Biosolids Anaerobic Digestion; and to authorize the expenditure if $935,000.00 from the Sewer Operating Fund. ($935,000.00)

WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities to authorize the Director enter into a contract with Suburban Propane, L.P. Suburban Sales & Services Inc for Offsite Biosolids Anaerobic Digestion; NOW, THEREFORE,

 

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS, OHIO:

 

SECTION 1. That the Director of Public Utilities be and is hereby authorized to enter into a contract with Suburban Propane, L.P. Suburban Sales & Services Inc for Offsite Biosolids Anaerobic Digestion in accordance with the terms, conditions and specifications on file.

 

SECTION 2.  That except as provided herein, all other provisions of Ordinance 2420-2025 shall remain in full force and effect; it is the intent of City Council that Ordinance 2420-2025 and this Ordinance be construed together as a single instrument, as appropriate.

 

SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
