Background:
The following is a resolution to declare the necessity and intent to appropriate construction easements in, over, under and through real estate in connection with the Portage Grove Area Sanitary Improvement Project.

Emergency Justification: Emergency action is requested to allow the acquisition of the parcels necessary for this project to proceed without delay in order to meet the Department of Public Utilities acquisition schedule.

To declare the necessity and intent to appropriate construction easements in, over, under and through real estate in connection with the Portage Grove Area Sanitary Improvement Project, and to declare an emergency.
Body
WHEREAS, the City of Columbus is engaged in the Portage Grove Area Sanitary Improvement Project; and,
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Sewerage and Drainage, in that it is immediately necessary to declare the necessity and intent to appropriate construction easements in, over, under and through the hereinbefore described real estate necessary for the aforementioned project so that there will be no delay in the project thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That this Council hereby declares the necessity and intent to appropriate construction easements in, over, under and through the following described real estate necessary for the Portage Grove Area Sanitary Improvement Project, Project #650700, pursuant to and in accordance with the Charter of the City of Columbus, Columbus City Code (1959) Revised, Chapter 909, the Constitution of the State of Ohio and Ohio Revised Code, Chapter 719; to-wit:

Situated in the State of Ohio, County of Franklin, City of Columbus, Lot 9 of Portage Grove Addition, Plat Book 24, Page 101, and being a temporary easement area more particularly described as follows:
Beginning for reference at the southwest corner of the east half of Lot 9, said point being in the north line of Southport Drive (50' wide); Thence South 87˚ East, along the north line of Southport Drive, the south line of Lot 9, 155.04 feet to a point of curvature to the left and being the point of beginning;
Thence North 33˚ East, into Lot 9, 42.26 feet to a point;
Thence South 26˚ East, 6.22 feet to a point in the west line of Southport Circle (50' wide);
Thence along the west line of Southport Circle with the arc of a non tangent curve to the right, having a radius of 150.00 feet, an arc length of 5.65 feet, a delta angle of 2˚, being subtended by a chord bearing South 1˚ West, a chord distance of 5.65 feet to a point;
Thence continuing with said right of way of Southport Circle, with the arc of a curve to the right, having a radius of 25.00 feet, an arc length of 39.30 feet, a delta angle of 90˚, and being subtended by a chord bearing South 47˚ West, a chord distance of 35.37 feet to the point of beginning;
Containing 364 square feet of land, or 0.008 acres.
For the purpose of this description, a bearing of South 87˚ East was used on the north line of Southport Drive, according to an actual field survey.
Section 2. That the City Attorney be and hereby is authorized to cause a written notice of the adoption of this resolution to be served upon the owners, persons in possession of or persons having a real or possible interest of record in the above described premises in the manner provided by law.
Section 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this resolution is declared to be an emergency measure and shall take effect and be in force from and after its adoption and approval by the Mayor, or ten days after adoption if the Mayor neither approves nor vetoes the same.
