Explanation

1.  BACKGROUND

This ordinance authorizes the Director of Public Service to modify a professional services contract with Woolpert, Inc. to add additional funds for design of the Arterial Street Rehabilitation - Cassady Avenue project.

Ordinance 2680-2017 authorized the Director of Public Service to enter into a professional services contract with Woolpert, Inc. in an amount of up to $525,000.00 for the Arterial Street Rehabilitation - Cassady Avenue project.  This project consists of improvements to Cassady Avenue from the CSX railroad tracks just north of Delmar Drive to E. 7th Avenue. Cassady Avenue is planned to be widened to a 3-lane section and reconstructed as a complete street with pedestrian and bikeway facilities, lighting, curb and gutter, and closed drainage. The project includes improvements to E. 5th Avenue at the intersection with Cassady Avenue.

 

Ordinance 0876-2020 authorized the Director of Public Service to modify the contract in the amount of $1,241,000.00 for final design.  Ordinance 2068-2022 authorized the Director of Public Service to modify the contract in the amount of $141,000.00 to advance utility coordination with AT&T along the corridor of Cassady Avenue in the project limits to reduce the time required for future utility relocations.  Ordinance 2860-2023 authorized the Director of Public Service to modify the contract in the amount of $30,000.00 for designing the storm control practices, utility and railroad coordination, and right of way coordination.

 

This ordinance authorizes the Director of Public Service to modify the contract in the amount of $30,000.00.

 

1.1  Amount of additional funds to be expended: $30,000.00

The contract amount including all modifications:             $1,964,607.64

 

1.2  Reasons additional goods/services could not be foreseen: 

This modification is necessary to encumber additional funds for additional effort in designing lighting, coordination with utilities, and services during bidding and construction. The City of Bexley requested changes to the plans within their corporate limits including modifications to the lighting design and curb ramp.

 

1.3  Reason other procurement processes are not used:

The project has been bid with construction anticipated to begin in spring of 2025. A scope and RFP could not be prepared and fee negotiated to complete the remaining work before the project is under construction.

 

1.4  How cost of modification was determined:

Some of the contract modification is to pay for services already provided. The consultant was aware of the sensitivity of this project to delays and made changes as requested and as quickly as possible. The remaining portion of the modification was determined based on anticipated necessary effort to complete the project. This information was used to negotiate a fee for the contract modification. The cost of this contract modification is consistent with the direct labor, overhead, and profit rates established within the original contract.

 

Searches in the System for Award Management (Federal) and the Findings for Recovery list (State) produced no findings against Woolpert, Inc.

 

2.  CONTRACT COMPLIANCE

The contract compliance number for Woolpert, Inc. is CC001040 and expires 4/17/2025

 

3.  FISCAL IMPACT

Funding in the amount of $30,000.00 is available and appropriated within the Streets and Highways Bond Fund, Fund 7704  within the Department of Public Service. 

 

4. MINORITY AND WOMAN OWNED BUSINESS ENTERPRISE & SMALL LOCAL BUSINESS ENTERPRISE PROGRAM

This expenditure is to modify a contract that was put in place prior to the implementation of the Minority and Woman Owned Business Enterprise & Small Local Business Enterprise program and as such is not a part of the program.

To authorize the Director of Public Service to enter into a contract modification with Woolpert, Inc. in connection with the Arterial Street Rehabilitation - Cassady Avenue project; to authorize the expenditure of up to $30,000.00 from the Streets and Highways Bond Fund for the project. ($30,000.00)

 

Body

WHEREAS, contract no. PO098332 with Woolpert, in the amount of $522,607.64, was authorized by ordinance no. 2680-2017; and

 

WHEREAS, modification no. 1, PO223483, in the amount of $1,241,000.00, was authorized by ordinance no. 0876-2020; and

 

WHEREAS, modification no. 2, PO338646, in the amount of $141,000.00, was authorized by ordinance no. 2068-2022; and

 

WHEREAS, modification no. 3, PO422070, in the amount of $30,00.00, was authorized by ordinance no. 2860-2023; and

 

WHEREAS, it has become necessary to modify the contract in an amount up to $30,000.00 and provide additional funds for the Arterial Street Rehabilitation - Cassady Avenue project; and

 

WHEREAS, to is necessary to authorize expenditures from the Streets and Highways Bond Fund for this contract; and

 

WHEREAS, this expenditure is to modify a contract that was put in place prior to the implementation of the Minority and Woman Owned Business Enterprise & Small Local Business Enterprise Program and as such is not a part of the program; now, therefore 

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

                     

SECTION 1.  That the Director of Public Service be, and hereby is, authorized to enter into a contract modification with Woolpert, Inc. at One Easton Oval, Suite 310, Columbus, OH 43219, for the Arterial Street Rehabilitation - Cassady Avenue project in the amount of $30,000.00, or so much thereof as may be needed, in accordance with the plans and specifications on file in the Department of Public Service, which are hereby approved.

 

SECTION 2.  That the expenditure of $30,000.00, or so much thereof as may be needed, is hereby authorized in Fund 7704 (Streets and Highways Bond Fund), Dept-Div 5912 (Design and Construction), Project P530103-100060 (Arterial Street Rehabilitation - Cassady Avenue), in Object Class 06 (Capital Outlay) per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  Funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 6.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
