Explanation
1. NEED:  This legislation authorizes the Director of Public Utilities to modify the professional engineering services contract with DLZ Ohio, Inc. for additional services related to construction contract procurement; Ohio EPA Permit to Install Fees; Backup Waste Activated Sludge Pump design costs and for on-line training of plant personnel all in connection with the Jackson Pike Wastewater Treatment Plant Sludge Handling and Dewatering Improvements Project for the Division of Sewerage and Drainage.  
 
2. PROFESSIONAL ENGINEERING SERVICES MOD. AWARD:  This contract is being funded incrementally by modification as the work progresses through the planned project steps from Preliminary Design through Services During Construction.  The contract total including this modification is $5,945,245.15.  The potential need for the additional work was foreseen and so stated in the original contract's legislation explanation, and is therefore a planned, continuation of the services as originally included within existing contract's scope of service.  It is not deemed either feasible or reasonable to suspend work with the entity currently under contract and undertake continuation of the work under a new procurement.  The cost of the modification is a continuation of the contractors' current pricing structure, as verified by City staff.  
 
3.  FISCAL IMPACT:  There is sufficient authority in the 2003 Capital Improvements Budget for this expenditure.  This project work will be funded at a future date by a loan from the State of Ohio Water Pollution Control Loan Fund (WPCLF) which is jointly administered by the Ohio Environmental Protection Agency and the Ohio Water Development Authority.

Body
WHEREAS, Contract No. CT19521 was authorized by Ordinance No. 1355-98, as passed by Columbus City Council on June 1, 1998, for purposes of preparing construction plans and specifications in connection with the Jackson Pike Wastewater Treatment Plant Sludge Handling and Dewatering Improvements Project, for the Division of Sewerage and Drainage, Department of Public Utilities; and
 
WHEREAS, Division of Sewerage and Drainage engineering personnel has determined it necessary to modify the subject contract in order to provide the additional Step 2 - Detailed Design Services and Step 3 - Services During Construction that are required for the Jackson Pike Wastewater Treatment Plant Sludge Handling and Dewatering Improvements Project; and
 
WHEREAS, it has been determined necessary for this City Council to authorize the Director of Public Utilities to modify the aforementioned professional engineering services modification with DLZ Ohio, Inc., for purposes of incorporating the additional Step 2 - Detailed Design Services and Step 3 - Services During Construction for the  Jackson Pike Wastewater Treatment Plant Sludge Handling and Dewatering Improvements Project at the earliest practicable date; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That from the unappropriated monies in the Sewerage System Reserve Fund No. 654, and from all monies estimated to come into said fund from any and all sources, and unappropriated for any other purpose during the fiscal year ending December 31, 2003, the sum of $162,890.90, is hereby appropriated to the Division of Sewerage and Drainage| Div. 60-05| Obj. Level 10| Obj. Level Three 5502| OCA Code 901553.
 
Section 2.  That the City Auditor is hereby authorized to transfer $162,890.90 from the Sewerage System Reserve Fund to the Ohio Water Pollution Control Loan Fund No. 666, into the JPWWTP Sludge Handling & Dewatering Improvements Project| Project No. 650246; at such time as deemed necessary by him, and to expend said funds, or so much thereof as may be necessary.
 
Section 3.  That the $162,890.90 is hereby appropriated for the JPWWTP Sludge Handling & Dewatering Improvements Project within the Ohio Water Pollution Control Loan Fund No. 666| Division 60-05| Project 650246| OCA Code 651246.
 
Section 4.  That the Director of Public Utilities be, and hereby is authorized to modify Contract No. CT-19521 with DLZ Ohio, Inc., 6121 Huntley Road, Columbus, Ohio 43229, for purposes of providing professional engineering services in connection with the Jackson Pike Sludge Handling & Dewatering Improvements Project, in accordance with the terms and conditions as shown in the contract modification agreement on file in the General Engineering Section of the Division of Sewerage and Drainage.
 
Section 5.  That for the purpose of paying the cost of the professional engineering services contract modification the expenditure of $162,890.90, or as much thereof as may be needed, is hereby authorized from the Ohio Water Pollution Control Loan Fund No. 666| Div. 60-05| Project 650246| OCA Code 651246| Object Level 6624.
 
Section 6.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
