Title: To authorize the Director of the Public Service Department to execute those documents required to transfer that portion of Wall Street from Hinman Avenue to Woodrow Avenue and that portion of the first alley south of Hinman Avenue between Wall Street and South High Street to the Salvation Army for $10,621.00 as recommended by the Land Review Commission; to waive the competitive bidding provisions of Columbus City Codes; and to declare an emergency.

Explanation
 
The City of Columbus, Public Service Department, Transportation Division, received a request from Advanced Civil Design, on behalf of Salvation Army, asking that the City transfer that portion of Wall Street from Hinman Avenue to Woodrow Avenue and that portion of the first alley south of Hinman Avenue between Wall Street and South High Street to the Salvation Army.  The Salvation Army is redeveloping that property commonly known as 1675 South High Street into an Adult Rehabilitation Center.  This center, will be fully self-supporting, and will include a family store, a work therapy building and a residence program area.  After transfer, Salvation Army intends to use these rights-of-way to optimize their parking lot design and for access to their facility.  Per current Transportation Division practice, comments were solicited from interested parties, including City departments, private utilities and applicable commissions, before it was determined that there would be no adverse impact to the City upon transfer of these rights-of-way, subject to the retention of a general utility easement for those utilities currently located within them.  The Department of Law, Real Estate Division, established a value of $10,621.00 for these rights-of-way.  The Land Review Commission voted to recommend the transfer of these rights-of-way to Salvation Army for the value established by the Real Estate Division.
 
Fiscal Impact:  The City will receive $10, 621.00, which will be deposited in Fund 748, Project 537650, as consideration for the transfer of these rights-of-way.
 
Emergency Justification:  Salvation Army has sold their existing building at 570 South Front Street and must vacate it quickly.  They are requesting emergency action so that these rights-of-way can be transferred, building rehabilitation at 1675 South High Street can be completed and the required move from their existing facility to the new facility can be finalized without delay.

WHEREAS, the Land Review Commission voted to recommend the transfer of these rights-of-way for the value established by the Real Estate Division, and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to authorize the Director to execute those documents required to transfer these rights-of-way to Salvation Army so that building rehabilitation can be completed and the Salvation Army's required move from their existing facility into their new facility can be finalized without delay for the preservation of the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of the Public Service Department be and is hereby authorized to execute quit claim deeds and other incidental instruments prepared by the Department of Law, Real Estate Division, necessary to transfer the following described rights-of-way to Salvation Army; to-wit:
 
Situated in the State of Ohio, County of Franklin, City of Columbus, Section 28 Township 5, Range 22, Refugee Tract, and being part of the first 20' alley west of South High Street and part of the first 20' alley south of Hinman Avenue as shown on the plat "Innis Sub" and recorded in Plat Book 3, Page 413 and described as follows:
Beginning at a pk nail set marking the southwest corner of Lot 12 of said "Innis Sub", the same being the intersection of the east right-of-way line for said first 20' alley west of South High Street with the north right-of-way line for Woodrow Avenue;
Thence S 88°12'08" W, across the right-of-way of said alley with the extension of said north right-of-way line, passing an iron pin set at 18.00 feet, 20.00 feet to the west right-of-way line for said alley, the same being a west line of Parcel 1 as shown in the deed to The Salvation Army of record in Instrument Number 200609080180240;
Thence N 01°51'52" W, with said west right-of-way line, 339.82 feet to an iron pin set marking a corner to said Parcel 1, in the south right-of-way line for said Hinman Avenue (see Ordinance 32644);
Thence N 88°12'08" E, across the right-of-way of said alley with said south right-of-way line, 20.00 feet to an iron pin set marking the northwest corner of Lot 5 of said "Innis Sub", in the east right-of-way line for said alley;
Thence S 01°51'52" E, with said east right-of-way line, 159.89 feet to an iron pin set marking the southwest corner of Lot 8 of said "Innis Sub", in the north right-of-way line for said first 20' alley south of Hinman Avenue;
Thence N 88°12'08" E, with said north right-of-way line, 135.17 feet to an iron pin set in the east right-of-way line for South High Street;
Thence S 01°51'52" E, with said east right-of-way line, being parallel and 45.00 feet west of the centerline of said South High Street, 20.00 feet to an iron pin set in the south line of said alley;
Thence S 88°12'08" W, with said south right-of-way line, 135.17 feet to a pk nail set marking the northwest corner of Lot 9 of said "Innis Sub", in the east right-of-way line for said first 20' alley west of South High Street;
Thence S 01°51'52" E, with said east right-of-way line, 159.89 feet to the Point of Beginning.  Containing 0.218 acre, more or less as calculated by the above courses.  The above description was prepared by John C. Dogdion, P.S. 8069 on March 07, 2007 and is based on existing records and an actual field survey.  A drawing of the above description is attached hereto and made a part hereof.
Iron pins set are ¾" diameter iron pipe, 30" long with plastic cap inscribed "Advanced 7661".
Bearings are based on the Ohio State Plane Coordinate System NAD83, South Zone (1986 Adj.).  A bearing of N 37°32'58" W was held between monuments FCGS8818 and FRANK134.  All references used in this description can be found at the Recorder's Office, Franklin County, Ohio.

Section 2.  That the above referenced real property shall be considered excess road rights-of-way and the public rights therein shall terminate upon the Director's execution and delivery of said quit claim deed to the grantee thereof.
 
Section 3.  That a general utility easement in, on, over, across and through the above described Young Street right-of-way shall be and hereby is retained unto the City of Columbus for those utilities currently located within said right-of-way.
 
Section 4.  That upon notification and verification of the relocation of all utilities located within the retained general utility easement the Director of the Public Service Department is hereby authorized to execute those documents necessary to release the retained general utility easement with no additional compensation due to the City and with no further legislative action required by the City.
 
Section 5.  That the $10,621.00 to be received by the City as consideration for the sale of these rights-of-way shall be deposited in Fund 748, Project 537650.
 
Section 6.  That this Council has determined it is in the best interest of the City of Columbus to allow these rights-of-way to be transferred without requiring competitive bidding and hereby waives the competitive bidding provision of Columbus City Codes (1959) Revised, Section 329.25 with regards to the transfer of these rights-of-way.
 
Section 7.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
