Explanation
BACKGROUND: This legislation authorizes the Finance and Management Director to modify past, present, and future contracts and purchase orders with BSN Sports LLC, which has undergone a reorganization. This ordinance authorizes the assignment of all past, present, and future business done by the City of Columbus from BSN Sports LLC, Tax ID to Varsity Brands, Inc.
No additional funds are necessary to modify the option contract(s) as requested. There is no change in the type of products being procured and the original contract was formally bid. The original terms and conditions remain in effect.
EMERGENCY DESIGNATION: The Finance and Management Department respectfully requests this legislation be considered an emergency in order to maintain an uninterrupted supply of Sporting Goods for the Department of Recreation and Parks.
FISCAL IMPACT: No additional funding is required to modify the option contract. The Department of Recreation and Parks must set aside their own funding for their estimated expenditures.

To authorize the Finance and Management Director to modify past, present and future contract(s) and purchase orders from BSN Sports LLC to Varsity Brands, Inc.; and to declare an emergency.
Body
WHEREAS, the Finance and Management Department, Purchasing Office has an option contract and open purchase orders for Sporting Goods for use by the Department of Recreation and Parks; and
WHEREAS, BSN Sports LLC has reorganized with a new name of Varsity Brands, Inc., and in addition to notifying the City, Varsity Brands, Inc. has agreed to honor the past, present, and future contracts and agreements of BSN Sports LLC; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Finance and Management in that it is immediately necessary to modify all contracts and purchase orders established and in process with BSN Sports LLC, for the immediate preservation of the public health, peace, property, safety, and welfare; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of the Department of Finance and Management is hereby authorized to modify all past, present, and future contracts and purchase orders pursuant to those contracts to reflect the change from BSN Sports LLC to Varsity Brands, Inc.
SECTION 2. That this modification is in accordance with relevant provisions of Chapter 329 of Columbus City Codes.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
