Title: To authorize the Director of the Department of Public Utilities to execute those instruments necessary to release a City owned sanitary sewer easement, located in the vicinity of Gender Road and Refugee Road.
Explanation
 
Background:    The City of Columbus, Ohio is the holder of a certain sewer easement, located in the vicinity of Gender Road and Refugee Road, by virtue of a recorded deed of easement.  The easement was originally intended for a public sewer line.  However, it has been determined by the Department of Public Utilities that the sewer line will remain private, and the City's easement should be released at no charge.  After investigation, it further been determined that the release of the subject easement will not adversely affect the City.  The following legislation authorizes the Director of the Department of Public Utilities to execute those instruments necessary to release the aforementioned sewer easement.

Title
 
To authorize the Director of the Department of Public Utilities to execute those instruments necessary to release a City owned sanitary sewer easement, located in the vicinity of Gender Road and Refugee Road.
 
Body
 
WHEREAS,      the City of Columbus, Department of Public Utilities, is the owner of a certain sewer easement, located in the vicinity of Gender Road and Refugee Road, by virtue of recorded instrument 200306060170954 in the Franklin County Recorders Office; and
 
WHEREAS,      the easement was originally intended for a public sewer line, however, it has been determined by the Division of Sewerage & Drainage that the sewer line will remain private, and the City's easement should be released at no charge; and
 
WHEREAS,      after investigation, the Department of Public Utilities has determined that the release of said easement will not adversely affect the operations of the City of Columbus; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
      Section 1.      That the Director of the Department of Public Utilities be, and hereby is authorized to execute those documents, prepared by the Department of Law, Real Estate Division, necessary to release a certain City owned sanitary easement in, over, under, across and through the following described real property:
 
DESCRIPTION OF 0.080 ACRE TRACT
EAST OF BRICE ROAD
WEST OF GENDER ROAD
SOUTH OF REFUGEE ROAD
 
Situated in the State of Ohio, County of Franklin, City of Columbus, being in the Northwest Quarter of Section 1, Township 11, Range 21, Congress Lands, and being 0.080 acres of the land conveyed to T & R Development, Inc. as recorded in Official Record Volume 23511 B05 (all references refer to records in the Franklin County Recorder's Office, Ohio) and more fully described as follows:
      Beginning for reference at a point on the westerly right of way of Gender Road at the southeast property corner of City of Columbus (ORV 15650 J10), also being a northeasterly property corner of said T & R Properties;
      Thence North 85° 31' 43" West 200.00 feet, along the southerly property line of said City of Columbus, to a point;
      Thence South 33° 07' 36" West 10.90 feet to a point being the Point of Beginning;
      Thence S 4° 28' 17" West 15.00 feet to a point;
      Thence North 85° 31' 43" West 232.59 feet to a point;
      Thence North 4° 28' 17" East 15.00 feet to a point;
      Thence South 85° 31' 43" East 232.59 feet to the Point of Beginning containing 0.080 acres more or less according to an actual field survey made by Hockaden and Associates, Inc. in March of 2003.
      Bearings are determined by GPS measurements, and based upon the North American Datum of 1983, from monumentation and published values as provided by National Geodetic Survey, the westerly right of way of Gender Road bearing South 3° 49 13" West.

Section 2.      That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
