Explanation
1. BACKGROUND: This legislation authorizes the Director of Public Utilities to enter into an agreement with Storts Excavation, Inc., 1167 McCarley Drive West, Columbus, Ohio 43228, for construction services for $127,266.00; to encumber funds with the Transportation Division for inspection/testing and prevailing wage coordination services for $20,000.00 and $1,000.00 respectively; and to transfer funds within the Storm Sewer Bond Fund for the Olde Sawmill Areawide Stormwater System Improvements Project in the amount of $148,266.00.
2. CONSTRUCTION CONTRACT AWARD: The Director of Public Utilities received and publicly opened one bid on July 2, 2003. This bid was received from Storts Excavation, Inc.; 31-1464608; $127,266.00. This figure reflects the actual bid plus a 20% contingency. Award is recommended to the LOWEST, RESPONSIVE AND RESPONSIBLE BIDDER. The amount of the contract is the amount of the proposed contractor's bid. However, it is entirely usual and it is reasonable to expect that this contract may later require modification in order to adjust for changed conditions, unknown conditions, operational failures during construction and other problems that are not known at this time.
3. EMERGENCY DESIGNATION: Emergency designation is requested for this ordinance so that the subject construction contract may be executed as soon as possible. Due to lack of funds, this contract could not be executed sooner. In order for the Director of Public Utilities to execute the contract this year, this ordinance must be processed as an emergency.
4. FISCAL IMPACT: There is sufficient authority for this project and funds will be transferred within the Storm Sewer Bond Fund to cover the required cash amount.

To authorize the Director of Public Utilities to contract with Storts Excavation, Inc. for costs associated with the Olde Sawmill Areawide Stormwater System Improvements Project for the necessary construction services; to provide for payment of construction inspection, testing and prevailing wage coordination services to the Transportation Division; to transfer funds within the Storm Sewer Bonds Fund for the Division of Sewerage and Drainage; and to authorize the expenditure of $148,266.00 within the Storm Sewer Bonds Fund; and to declare an emergency. WHEREAS, a bid for construction of the Olde Sawmill Areawide Stormwater System Improvements Project was received on July 2, 2003; and
WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to award and execute a construction contract and to encumber and expend funds to provide for payment of inspection, testing and prevailing wage coordination services costs associated with the Olde Sawmill Areawide Stormwater System Improvements Project. This will allow the construction services to begin at the earliest practicable date; and
WHEREAS, it is necessary to transfer funds within the Storm Sewer Bonds Fund for the aforementioned costs; and
WHEREAS, an emergency exists in the usual daily operations of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary to authorize the Director of Public Utilities to contract for the aforementioned project for the preservation of the public health, peace, property and safety; now therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Auditor is hereby authorized and directed to transfer monies within the Storm Sewer Bonds Fund, Fund 685 as follows:
Division of Sewerage and Drainage, Division 60-15
TRANSFER FROM: 610906, Fairwood Avenue/Smith Road Drainage Project, $148,266.00
TRANSFER TO: 610702. Olde Sawmill Areawide Stormwater System Improvements Project, $148,266.00
Section 2. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be so made from a project account by monies from more than one source.
Section 3. That the Director of Public Utilities be, and hereby is, authorized to award and execute a contract for construction of the Olde Sawmill Areawide Stormwater System Improvements with the lowest and best bidder, Storts Excavation, Inc., 1167 McCarley Drive West, Columbus, Ohio 43228, in the amount of $127,266.00 in accordance with the terms and conditions of the contract on file in the Office of the Division of Sewerage and Drainage; and to obtain the necessary inspection, testing and prevailing wage coordination services from the Transportation Division; and to pay up to a maximum amount of $21,000.00.
Section 4. That for the purpose of paying the cost of the construction contract, the cost of inspection, testing and prevailing wage coordination services, the following expenditure, or as much thereof as my be needed is hereby authorized as follows: Division 60-15, Fund 685, Project 610702, Object Level Three 6621, OCA Code 685702, Amount $148,266.00.
Section 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
