Explanation
BACKGROUND:
This ordinance approves the acceptance of certain territory (AN24-013) by the city of Columbus. The Ohio Revised Code stipulates that to be effective, City acceptance must take place a minimum of 60 days from the receipt by the City Clerk of the approval notice from the county. If City Council does not accept the ordinance within 120 days of its first consideration, the annexation will be considered rejected. This petition was filed with Franklin County on April 25, 2025. City Council approved a service ordinance addressing the site on February 3, 2025. Franklin County approved the annexation on July 8, 2025 and the City Clerk received notice on July 23, 2025.
FISCAL IMPACT:
Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.

WHEREAS, a petition for the annexation of certain territory in Franklin Township was filed on behalf of Columbus MHP, LLC on April 25, 2025; and
WHEREAS, the petition was considered and approved by the Franklin County Board of Commissioners at a hearing on July 8, 2025; and
WHEREAS, on July 23, 2025, the City Clerk received from Franklin County a certified copy of the resolution addressing the petition; and
WHEREAS, sixty days have now elapsed since receipt of the resolution in accordance with the provisions of the Ohio Revised Code; and
WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory addressed by the petition; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
SECTION 1. That the annexation proposed by Columbus MHP, LLC in a petition filed with the Franklin County Board of Commissioners on April 25, 2025 and subsequently approved by the Board on July 8, 2025 is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:
The following described 1.891 acre tract is situated in the State of Ohio, Franklin County, Franklin Township, VMS 1482 and VMS 3315, being part of a 6.870 acre tract (Franklin Township Parcel 140-007492) as conveyed to Columbus MHP LLC by Instrument Number 201610190142586, and being more particularly described as follows:
Beginning in the West line of Wilson Road (width varies), at the Southeast corner of a 37.1775 acre tract conveyed to Buckeye Terminals LLC by Instrument Number 201106130073820, the Southwest corner of Parcel 15WD as conveyed to the City of Columbus by Official Record 5685 F16, the Northwest corner of Parcel 8WD as conveyed to the City of Columbus by Official Record 6332 J08 and the Northeast corner of said 6.870 acre tract, being in the line between Franklin Township and the City of Columbus (Case Number COC 125, Ordinance Number 1654 - 56, recorded in 98 - 601), said point bears North 12° 41' 18" East a distance of 1694.97 feet and North 78° 36' 30" West a distance of 29.91 feet from the centerline intersection of Wilson Road and West Broad Street (width varies);
Thence, with the West line of said Wilson Road and said Parcel 8WD, the East line of said 6.870 acre tract and with said existing City of Columbus Corporation line, South 12° 47' 16" West a distance of 59.32 feet to a corner to said Corporation line;
Thence, across said 6.870 acre tract and with said existing City of Columbus Corporation line, North 78° 42' 58" West, passing a corner to a Corporation line of the City of Columbus (Case Number 54-87, Ordinance Number 657 - 88, recorded in Official Record 11475 C19) at 1289.79 feet, continuing with said existing City of Columbus Corporation line, a total distance of 1313.21 feet to a corner of an 82.575 acre tract conveyed to BIGOOH002 LLC by Instrument Number 202208110116180;
Thence, with said 82.575 acre tract and with said existing City of Columbus Corporation line with the following two courses:
1) North 78° 37' 32" West a distance of 46.40 feet;
2) North 12° 56' 58" East a distance of 61.81 feet to the Southwest corner of said 37.1775 acre tract;
Thence, with the South line of said 37.1775 acre tract and with the proposed Corporation line, South 78° 36' 30" East a distance of 1359.37 feet returning to the Point of Beginning, containing 1.891 Acres more or less.
The total perimeter of the proposed annexation area is 2840.11 feet, of which 1480.74 feet is contiguous with the current corporation line of the City of Columbus, having 52.1% contiguity. Bearings are based on the north line of said 6.870 acre tract (South 78° 36' 30" East) as described in Instrument Number 201610190142586.
Subject to and with the benefit of all legal highways, restrictions, easements, limitations, and reservations, of record, if any and to zoning restrictions which have been imposed thereon, if any.

SECTION 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.
SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
