The following is a resolution to declare the necessity and intent to appropriate construction easements in, over, under and through real estate in connection with the Big Walnut Augmentation Interceptor-Rickenbacker Intermodal Project.

Emergency Justification:
Emergency action is requested to allow the acquisition of the parcels necessary for this project to proceed without delay in order to meet the Department of Public Utilities' acquisition schedule.
 
 
Title
 
To declare the necessity and intent to appropriate construction easements in, over, under and through real estate in connection with the Big Walnut Augmentation Interceptor-Rickenbacker Intermodal Project, and to declare an emergency.
 
 
Body
 
WHEREAS,      the City of Columbus is engaged in the Big Walnut Augmentation Interceptor-Rickenbacker Intermodal Project; and,
 
WHEREAS,      an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Sewerage and Drainage, in that it is immediately necessary to declare the necessity and intent to appropriate construction easements in, over, under and through the hereinbefore described real estate necessary for the aforementioned project so that there will be no delay in the project thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
 
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
      Section 1.      That this Council hereby declares the necessity and intent to appropriate construction easements in, over, under and through the following described real estate necessary for the Big Walnut Augmentation Interceptor-Rickenbacker Intermodal Project, Project #650491, pursuant to and in accordance with the Charter of the City of Columbus, Columbus City Code (1959) Revised, Chapter 909, the Constitution of the State of Ohio and Ohio Revised Code, Chapter 719; to-wit:
 
PARCEL 2DT
Situated in the State of Ohio, County of Franklin, Township of Hamilton, located in Section 10, Township 3, Range 22, Matthews Survey of Congress Lands East of the Scioto, being across the 47.00 acre tract conveyed to William M. Lane, Trustee by deed of record in Official Record 27575008, and Sarah Lane Crabtree, Trustee by deed of record in and Instrument Number 199906280163165 (all references refer to the records of the Recorder's Office, Franklin County, Ohio) and being described as follows:
BEGINNING at the northwesterly comer of said 47.00 acre tract, in the line common to said Section 10 and Section 3 of said Township and Range;
thence South 86°38'46" East, with the line common to said Sections 3 and 10, a distance of 78.71 feet to the northwesterly corner of an existing sanitary sewer easement of record in Instrument Number 200211120286444;
thence across said 47.00 acre tract, the following courses and distances:
South 29°36'40" East, with the westerly line of said existing easement, a distance of 253.41 feet to a point in the northerly line of an existing sanitary sewer easement of record in Instrument Number 200211120286445;
South 60°23'20" West, continuing with said existing easement line, a distance of 46.05 feet to a point;
with a curve to the right, having a central angle of 13°38'08", a radius of 770.00 feet, an arc length of 183.25 feet, and a chord which bears North 75°05' 58" West, a chord distance of 182.82 feet, continuing with said existing easement line, to a point in the westerly line of said 47.00 acre tract;
thence North 03°41'05" East, with said westerly line, a distance of 201.08 feet to the POINT OF BEGINNING, and containing 0.778 acre of land, more or less.
The bearings are based on the Ohio State Plane Coordinate System, South Zone, NAD83 (1986 Adjustment). Said bearings originated from a field traverse, which was referenced to said coordinate system by GPS observations of Franklin County Geodetic Survey Monuments, Smith and FCGS 9926. The grid bearing between said monuments being N 71°52'56" W. Distances shown hereon are ground distances.

Beginning, for reference, at the northwesterly comer of said 47.00 acre tract, in the line common to said Section 10 and Section 3 of said Township and Range;
thence South 03°41'05" West, with the westerly line of said 47.00 acre tract, a distance of 263.94 feet to a southwesterly comer of an existing sanitary sewer easement of record in Instrument Number 200211120286445, the TRUE POINT OF BEGINNING;
thence across said 47.00 acre tract, the following courses and distances:
with a curve to the left, having a central angle of 12°31'49", a radius of 830.00 feet, an arc length of 181.52 feet, and a chord which bears South 75°53'25" East, a chord distance of 181.15 feet, with the southerly line of said existing easement, to a point;
South 29°36'40" East, partly with a westerly line of said existing easement, a distance of 84.20 feet to a point;
South 72°20'24" East, a distance of 209.36 feet, to a point in the westerly line of the 42.936 acre tract conveyed to Columbus & Southern Ohio Electric Company by deed of record in Deed Book 3268, Page 641;
thence with said westerly line, the following courses and distances:
South 38°41'47" East, a distance of 26.62 feet to a point;
South 52°00'53" East, a distance of 180.26 feet to a point;
South 69°46'41" East, a distance of 72.42 feet to a point;
thence North 86°18'55" West, across 47.00 acre tract, a distance of 663.83 feet to a point in the westerly line thereof;
thence North 03°41'05" East, with said westerly line, a distance of 295.58 feet to the TRUE POINT OF BEGINNING, and containing 2.464 acres of land, more or less.

      Section 2.      That the City Attorney be and hereby is authorized to cause a written notice of the adoption of this resolution to be served upon the owners, persons in possession of or persons having a real or possible interest of record in the above described premises in the manner provided by law.
 
      Section 3.      That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this resolution is declared to be an emergency measure and shall take effect and be in force from and after its adoption and approval by the Mayor, or ten days after adoption if the Mayor neither approves nor vetoes the same.
