Explanation

1. BACKGROUND:  This legislation authorizes the Director of Finance and Management, on behalf of the Office of Construction Management, to modify and increase the architectural / engineering services agreement, with BBCO Design LLC, for the 2026 Data Center West Facility Upgrades project, in the amount of $154,660.00.

This is a multi-phase project.  Phase 1, under Contract No. PO573937, was to identify areas that needed improvements and provide an estimate of cost for those projects in order to prioritize them.

Modification No. 1 (current) is needed for Phase 2 and enables BBCO to proceed with the design phase and provide working drawings for construction purposes.

2. MODIFICATION INFO:

A.  The amt of additional funds to be expended under the modification:  $154,660.00

Original Contract Amount:                     $282,791.00 (PO573937)

Modification No. 1 (current):                     $154,660.00

Total (Original & Mod 1):                     $437,451.00

B. Why the need for additional goods or services could not be foreseen at the time the contract was initially awarded.

The original contract was awarded through the RFP process and awarded to BBCO. They proceeded to identify areas that needed improvements and provided an estimate of costs for those projects in order to prioritize them.  This modification is to proceed with the design phase and provide working drawings for construction purposes.

C. Why it would not be in the city’s best interests to have the additional contract requirements awarded through other procurement processes?

This multi-phase process ensures a smooth transition, preserves critical project context, and eliminates the inefficiencies of re-explaining goals to a new team. Bypassing a second bidding phase will allow the project to move faster into execution.

D.  How the price for the additional goods or services which are subject of the modification was determined.

The vendor provided a fee proposal and was accepted by the City.

3.  CONTRACT COMPLIANCE INFO: BBCO Design LLC, DAX No. 19748, expires 11/19/27, WBE & SRBE -designated.

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against BBCO Design LLC.

4. FISCAL IMPACT: There are sufficient funds within the Information Services Capital Projects Fund - Fund No. 5105.
