Explanation
BACKGROUND: This legislation amends ordinance 0069-2012, which passed City Council February 2, 2012. Ordinance 0069-2012 established purchase orders with various vendors including fuel purchased through the Voyager card for the Fleet Management Division from Universal Term Contracts ("UTC's").  One of the vendors listed on this ordinance is Voyager Fleet Systems Inc., with an original contract expiration date of 07/31/2012 and an extended contract expiration date of 10/31/2012.
With the impending contract expiration for Voyager, the Purchasing Office advertised and solicited competitive proposals (via SA004359) on May 17, 2012, in accordance with Section 329.14.  Submitted proposals were reviewed by the Purchasing Office and Purchasing is recommending bid award to MPC Investments LLC (Speedway LLC, SuperFleet).  The ordinance number for the authorization of this award is 2280-2012.   
 
This ordinance seeks to add the new SuperFleet contract for credit card fuel purchases to the original ordinance (0069-2012), thereby granting the Fleet Management Division spending authority from the auditor's certificate established previously pursuant to Ordinance 0069-2012.
 
FISCAL IMPACT: This ordinance does not require any additional spending authority, only the use of an established auditor's certificate pursuant to the award of a new Universal Term Contract with SuperFleet
Contract compliance number is 27-1287018, which expires 05/21/2014.
 
Emergency action is requested as there is an immediate need to continue the use of credit card fuel purchases for use on City vehicles and supply uninterrupted service which effects daily operations.

Body
WHEREAS, the Finance and Management Department, Fleet Management Division, has a need for universal credit card purchases for use by various City department vehicles; and
 
WHEREAS, the current contract with Voyager Fleet Systems, Inc. expires 10/31/2012 and Solicitation SA004359 will establish a new universal term contract for credit card fuel purchases; and
WHERAS, via companion legislation (Ord. 2280-2012), the Purchasing Office is recommending the award of the new credit card fuel purchasing contract to MPC Investments LLC (Speedway LLC, SuperFleet).
WHEREAS, this ordinance authorizes the Fleet Management Division to use funding established pursuant to Ordinance 0069-2012 [AC 033275-002] for the purpose of credit card fuel purchases.  This auditor's certificate has an available balance of $1,789,580; and
 
WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department, Fleet Management Division in that it is immediately necessary to be able to issue purchase orders for various credit card fuel purchases, to ensure an uninterrupted fuel supply for City vehicles, including Police, Fire, and Refuse Collection Division vehicles, thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1. That ordinance 0069-2012, passed February 1, 2012, Section 4. is hereby amended to include the new credit card fuel purchases with SuperFleet, established via Solicitation SA004359.
      from:
      Section 4.   That the Finance and Management Director is hereby authorized to issue a purchase order with Voyager Fleet Systems Inc for Universal fuel credit card services, in accordance with the Universal Term Contract FL001215, which expires 07/31/2012.
      to:
 
      Section 4.   That the Finance and Management Director is hereby authorized to issue purchase orders with Voyager Fleet Systems Inc. in accordance with Universal Term       Contract FL001215, which expires 07/31/2012, and with MPC Investments LLC (Speedway LLC, SuperFleet) under a pending UTC for fuel credit card services.
 
SECTION 2. That the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
